County Commissioner Ordinance - March 1991.' .° i� a ORDINANCE NO. 91- � An Ordinance Of Gibson County, Indiana Designating and Establishing Gibson County As A Solid Waste Management District WHEREAS, I.C. 13-9.5-2 requires each county in the State of Indiana, including Gibson County to either establish itself as a county solid waste management district or to join with one or more counties in the formation of a joint solid waste n�anagement district no later than July 1, 1991; and WHEREAS, I.C. 13-9.5-2-1 requires such establishment as a designation by way of ordinance of the county esecutive; and WI-IEREAS, the Commissioners of Gibson County currently serve as the county eaecutive of Gibson County; and WHEREAS, the Commissioners of Gibson County believe a single county solid waste manaqement district is appropriate for the needs of Gibson County; NOW THEREFORE BE IT ORDAINED BY THE BOARD OF CONB�'lISSIONERS OF GIBSON COUNTSt, INDIANA: 1. As of Ihaa./S�R�11 , the Gibson County Solid Waste Management District shall egistr 2. All territory of Gibson County whether currently incorporated as a municipality or unincorporated shall be included within and subject to the Gibson County Solid Waste Management District. 3. Such district shall have all powers allowed to county solid waste management districts as provided by the statutes of the State of Indiana as amended including, but not limited, the powez to: a. Develop and implement a district solid waste management plan. b. Impose district fees on the final disposal of solid waste within the district. c. Receive and disburse funds. � d. Sue and be sued. � e. Borrow money. f. Plan, design, construct, finance, manage, own, lease, operate, maintain and otherwise control facilities for solid waste management. g. Contract. h. Lease. i. Purchase, lease or otherwise acquire real or personal proper.ty. 0 � 7• k 1. m. a�b a Sell, lease or otherwise dispose of facility or a part thereof. Make, contract for, or otherwise deal with plans, surveys, studies, or investigations necessary for the management or disposal of solid waste. Enter on property to make surveys, soundings, borings, or any other ezamination. Accept gifts, grants, loans, property or services from any source. n. Levy a taa operation management, procedures. o. P• 4• r. within the district to pay all costs of in connection with the solid waste subject to regular budget and taa levy Sorrow in anticipation of taaes. Hire all necessary personnel. Do all things necessary for the reduction, management and disposal of solid waste as well as the recovery of waste products from the solid waste stream. Adopt resolutions that have the force of law.
