County Commissioner Ordinance - April 1984/' .. � , " V ORDINANCE NO. 1984� AN ORDINANCE REGULATING THE PUBLIC DISPOSAL OF REFUSE �, � BE IT ORDAINED AND ENACTED by_the Board of Commissioners of Gibson County, State of Indiana, as follows: ARTICLE I- Definitions: The following definitions shall apply in the interpretation and enforcement of this Ordinance: Section 101 -"Refuse" includes solid and semi-solid wastes, dead animals and offal. Section 102 -"PUblic disposal" shall mean and relate to disposal of refuse which has been removed from premises used, owned or leased by one or more persons, firms, corporations or associations and transported to other premises and disposed of either with or without the payment of a fee. Section 103 -"Health officer" shall mean the Gibson County health officer or his authorized representative. Section 104 -"Person" shall mean any person, firm,. corporation or association. Section 105 -"Salvaging" means the controlled removable of reusable materials. Section 106 -"Scavenging" means the uncontrolled picking of materials. Section 107 -"BOard of Commissioners" shall mean the Board < of Gibson County Commissioners or their authorized representative. Section 108 -"Containers" shall mean sanitary receptacles for the receipt of refuse located at various points within the County. Page 1 of 5 Pages I . . '' _ c� � Section 109 -"Container site" shall mean the area immediately surrounding a container. Section 110 -"Refuse vehicle" shall mean any vehicle utilized for the transportation of refuse. ARTICLE II - Permits: Section 201 - It shall be unlawful for any person who does not possess an unrevoked annual disposal permit from the health officer for each refuse vehicle operated to engage in Gibson County in the comriercial pickup and disposal for profit of refuse from premises to a location other than the place of origin of such refuse for disposal. Section 202 - Disposal permit shall be for the term of one (1) year and shall be renewable annually. Any disposal permit issued by the health o£ficer shall contain the name of the person to whom the permit is granted, the identification number and licensing information for that particular refuse vehicle, the address of the person to whom it is issued and such other pertinent information as may be required by the health officer. A disposal permit may be temporarily suspended by the health officer upon violation by the holder of any of the terms of this Ordinance or may be revoked after an opportunity for a hearing by the health officer upon serious or repeated violation. Section 203-- No permit signed by the health officer shall be valid until it has been countersigned by the Treasurer of Gibson County. A permit fee in the amount of Five Dollars ($5.00) shall be paid to the Treasurer of Gibson County. Section 204 - It shall be unlawful to deposit dead animals at the County landfill site or in a container or at a container site. Page 2 of 5 Pages .. . Section 205 - All persons.:who are residents of Gibson County, including business establishments; who do not engage in the com-__ mercial pickup and disposal of refuse for profit will be permitted to deposit refuse at the Gibson County landfill site or at any Gibson County container site without charge. Section 206 - Before a permit is issued by the health officer for the collection and transportation of refuse, all equipment and refuse vehicles to be used which require a permit, shall be; inspected by the health officer. All equipment and refuse vehicles used to transport refuse to a disposal site shall be covered and all vehicles requiring permits shall be water tight and shall be cleaned as may be necessary to prevent nuisances and health hazards. ARTICLE III - Sanitary re4uirements: Section 301 - Salvaging, if permitted, shall be organized so that it will not interfere with prompt sanitary disposal of refuse or create unsightlyness or health hazards. Scavenging shall not be pernitted. Section 302 - No refuse shall be burned at a container site. Section 303 - It shall be unlawful for any person to put, throw or dump refuse in or upon a container site; all refuse shall be put into the containers provided. Section 304 - It shall be unlawful for any person to put, throw, dump or leave large and bulky items in refuse containers such as ice boxes, chairs, tables, sofas, tree limbs, brnsh cuttings, fence, posts, pipe, etc. (bricks, stones or dirt when total weight is more than 50 pounds). All such items shall be taken directly to the County sanitary landfill. Section 305 - It shall be unlawful for any person to put, throw, dump or leave hazardous material, including but not limited to, explosives, pathological wastes, radioactive materials and chemicals. Page 3 of 5 Pages . . • v c, �i` Section 306 - It shall be unlawful for any person to move, mutilate, destroy, disfigure or cause damage to refuse containers. Section 307 - It shall be unlawful for any person to deposit burning material at a landfill site, in containers or at a con- tainer site. Section 308 - It shall be unlawful for a commercial refuse hauler to deposit refuse in containers. Commercial refuse haulers must deliver refuse to the County landfill site. Section 309 - It shall be unlawful for any person not a resident of Gibson County to deposit refuse at the landfill site or at any container site without permission of the health officer of Gibson County. ARTICLE IV - Enforcement: Section 401 - The enforcement of this Ordinance shall be by the Gibson County health officer. Section 402 - It shall be the duty of the Gibson County prosecuting attorney to whom the Gibson County health officer shall report any violation of the provisions of this Ordinance and to cause proceedings to be taken against the person violating the provisions of this Ordinance. ARTICLE V - Penalties: Section 501 - Any person_violating any provision of this Ordinance shall be guilty of a misdemeanor and on conviction shall be punished by a fine of not more than One Thousand Dollars ($1,000.00) to which may be added imprisonment for a determinant period not exceeding one hundred eighty (180) days. ARTICLE VI - Effective date: Section 601 - This Ordinance shall be in full force and effect immediately upon its adoption and its publication as provided by law. But in checking the statute I found this ordinance requires two publications and I advised you of same on the phone. Please consider this as a written notice to the effect that•this ordinance should be pub- lished on April 26, '1984 and May 3, '1984 ... these dates are required to meet the regulations in the statute.
