County Commissioner Ordinance - April 1996 (2)1 t�i( � ORDINANCE N0. 1996- � AN ORDINANCE PROVIDING FOR THE ENFORCEMENT OF CERTAIN ORDINANCES BY ADMINISTRATIVE PROCEEDING wHEREAS, indiana Code 36-1-6-9 provides that the Board of County Commissioners of Gibson County, Indiana may adopt an Ordinance providing that certain ordinances of Gibson County may be enforced through a proceeding before an Administrative body; and WHEREAS, Gibson County has previously adopted Ordinance 1980-1; 1984-2 "An Ordinance Regulating the Public Disposal of Refuse"; and Ordinance 1990-1 which amends Ordinance 1984-1; and WHEREAS, the Board of County Commissioners of Gibson County, Indiana has determined that each of said Ordinances named herein should be enforced under the terms of Indiana Code 36-1-6-9; NOw, THEREFORE, BE IT ORDAZNED by the Board of County Commissioners of Gibson County, Zndiana as follows: SECTION 1. The Board of County Commissioners of Gibson County, Indiana in accordance with Indiana Code 36-1-6-9 hereby elect to enforce Ordinance Nos. 1980-1, 1989-2 and 1990-1, through a proceeding before an Administrative body of Gibson County instead of a proceeding brought in accordance with Indiana Code 34-4-32. SECTZON 2. The Administrative body of Gibson County before whom said proceedings shall be brought will be the Board of County Commissioners of Gibson County, Indiana. SECTION 3. Any individual charged with violation of any of. said Ordinances named herein shall be ORDERED and DIREC`i'ED to appear before the Board of County Commissioners of Gibson County, Indiana. A brief statement setting out the nature of the violation together with a Summons shall be served upon the individual either personally by the Sheriff of Gibson County, Indiana or by Certified Mail, Return Receipt Requested.
