County Commissioner Ordinance - December 1996. _ i�a ORDINANCE N0. 1996- � AN ORDINANCE REQUIRING MAINTENANCE OF RIGHTS OF WAY AT RAILROAD CROSSINGS WHEREAS Gibson County, Indiana has numerous railroad crossings which pose a potential threat to the safety and we11- being of the users of the county road system in Gibson County, Indiana; and WHEREAS, the Board of County Commissioners of Gibson County, Indiana has determined it is in the best interests and general welfare of the users of the county road system in Gibson County, Zndiana that certain minimal vision requirements be available for users of the county road system at its intersection with railroad crossings; NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Gibson County, Indiana as follows: 1. All real estate owners in Gibson County, Indiana, including but not limited to all railroads, shall cause their real estate to be maintained in such fashion as will permit a vision clearance for users of the Gibson County road system of not less than 1,500 feet in both directions at all railroad crossings. 2. Any person or entity who violates this ordinance shall be subject to a fine not to exceed the sum of One Thousand Dollars ($1,000.00) for each day said real estate remains in violation of this Ordinance. 3. In the event any owner of real estate should fail to comply with this Ordinance, the Board of County Commissioners has the right to require enforcement thereof by seeking an injunction against the owner to require compliance with the vision clearance set forth under this Ordinance. 9. The enforcement of this Ordinance will be administered in the Administrative Court of the Gibson County Commissioners. 5. This Ordinance shall be in full force and effect January 1, 1997.
