AN ORDINANCE TO VACATE A 30' PUBLIC UTILITY AND INGRESS AND EGRESS
EASEMENI' WITHIN GIBSON COUNI'Y, INDIANA CONIMONLY KNOWN AS A
PORTION OF A 2.11 ACRE PARCEL CONVEYED TO EVANSVILLE HOTEL VENT[JRES,
LLC IN A WARRANTY DEED RECORDED AUGUST 4, 1998 AS DOCUMENT NUMBER
98-5525 AND ORIGINALLY RECORDED AS DOCUMENT NUMBER 96-5497.
BE IT ORDAINED by the County Commissioners of Gibson County, Indiana, as follows, to-wit:
Section 1. A verified petirion was presented to the County Commissioners of Gibson County
requesting that a portion of the 30' Public Utility Easement and Ingress and
Egress Easement described in Section III be vacated.
Section II. That after due and proper notice a timely public hearing was convened by the
Counry Commissioners, at which rime all interested persons were permitted to
address regarding said vacation.
Section III. That the Counry Commissioners of Gibson County, after due investigation and
consideration has determined that the nature and eatent of public use and the
public interest to be observed is such as to warrant the vacation of that part of the
public �vay or public place as described in Exhibit "A", and fiuther indicated by
the words "To Be Vacated" on the drawing labeled Exlvbit "B", which is made a
part of this Ordinance.
Therefore, the Counry Commissioners of Gibson County, Indiana, does hereby find the above
described Public Utility Easement and Ingress and Egress Easement is no longer required for
public use and the public interest will be served by such vacation that portion of the Public
Utility Easement and Ingress and Egress Easement described in Section III above subject to the
terms and conditions as stated in this Ordinance.

Easement within the described 2.110 acre parcel conveyed to Evansville Hotel
Veritures, LLC as described in a Warranty Deed from Ranchodbhai D. Patel and
Manuben R. Patel, dated July 29, 1998 and recored August 4, 1998 as document
number 98-5525 in the office of the recorder of Gibson County, Indiana, more
particulary described as follows:
Part of the Southwest Quarter of Section 17, Township 4 South, Range 10 West
in Gibson County, Indiana, being more particularly described as follows:
Commencing at the northwest comer of the northeast quarter of the southwest
quarter of said section; thence along the north line of said quarter section North
89 degrees 56 minutes 34 seconds East 754.18 feet, said point being located
South 89 degrees 56 minutes 34 seconds West 581.23 feet from the northeast
comer of the southwest quarter of said section; thence South 00 degrees 54
minutes 30 seconds West 1407.56 feet to the northwest comer of said 2.110
acre parcel; thence continue south along the west property line of said 2.110
acre parcel South 00 degrees 54 minutes 30 seconds West 16.00 feet to the true
point of beginning; thence northeast and parallel with the north property line of
said parcel North 89 degrees 56 minutes 34 seconds East 30.00 feet; thence
south and parallel with the west property line of said parcel South 00 degrees 54
minutes 30 seconds West 385.96 feet to a point along the south property line of
said parcel; thence southwest and along the south property line of said parcel
