CONTROLLED OR OCCUPIED BUILDINGS (ORDI�IANCE NO. 2001-01)
AN ORDINANCE REGULATING THE PUBLIC DISPOSAL OF REFUGE

WHEREAS, Gibson Countv. Indiana, through its Board of Counry Commissioners has
dulv adopted the above referenced ordinances.
R'HEREAS, none of the ordinances specifically provided for a procedure for handling of
citations issued for the violation of such Ordinances nor the application of the fines paid
by violators.

WHEREAS, Gibson Counh�, Indiana desires to establish a procedure for the
administtation of the Ordinances and violations thereof and the application of the fine `_' l
money paid by violators. I
NOW. THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF GIBSON COUNTY, NDIANA; AS FOLLOWS:
1. All violators shall appeaz before the Commissioners' Court which shall be
held during the regular meetine on the third Monday of each month. The -- _.
Commissioners' Court shall be a regular item on the agenda during the second meeting of
each month at 9:00 A.M.
2. Law enforcemeni officers issuing citations for violation of any ordinance
providing for a fine may use the Uniform Traffic Tickei provided to them through their
departments and note thereon that the violator shall appear at the Commissioners Court
on the third Monday of each month. In the event a citation is issued less than ten (10)
days prior to the third Monday of each month. then the officer should make the
appeazance date of the alleged violator the third Monda�� of the following month so that
there will be ample time for the violator to determine his defense, exercise his rights and
seek the advice of an attomey, if desired.

3. Should the meeting time of the Board of Commissioners change in any
future calendar years, the Commissioners Court shall alwavs be held on the second
meeting of each month.
4. All fines shall be paid at the Office of the Auditor of Gibson Counri�.
Indiana, in the Courthouse, Princeton, Indiana. Officers issuing citations for the
Ordinances herein referred to shall �otify the alleged violator that he may pay the fine at
the Gibson County Auditor's Office without appearing at the Commissioner's Court
provided the fine is paid prior to the appearance date.
5. In order to facilitate the payment of fines ��ithout appearing before the
Commissioners' Court, the Commissioners shall from time to time file with the Gibson
Counri Auditor a schedule of fines for the first offense of each Ordinance. On a second
offence the alleged violator must appear before the Commissioners' Court.
6. Officers shall file the original citation with the Auditor of Gibson Count}�,
Indiana, with a copy to the County Attomey.
7. A. The money received in the pati�nent of fines shall be applied by the
Auditor as follows:
i. Fines under the No Smol:ing Ordinance (Ordinance No. 2001-01)
shall go to the General Fund.
ii. Fines paid under the Ordinance Regarding the Control and
Disposition of Animals (Ordinance No. 2000-2) shall go the care of animals at the
Gibson Counry Animal Service.
iii. Fines paid under the Trash Ordinance (Ordinance No.1984-2) shall
go to the Recycling Education Fund.
iv. Fines paid under of the Food Ordinance (Ordinance No. 2000-7)
shall go to the Health Commission Fund
B. License fees collected under the Food Ordinance (Ordinance No. 2000-7)
shall be paid direcdy to the Health Commission Fund which is subject to audit by the
Indiana State Board of Accounts.
C. The Auditor shall disburse the funds from fines paid as herein provided
upon the presentment of properly approved claims.
BE IT FURTHER ORDAINED that the County Attorney shall send a copy of this
Ordinance to the Gibson County Sheriffs Department and to the Police Department of
each city and town in Gibson Counry, Indiana.

BE IT FURTHER ORDAINDED that any Ordinance in conflict writh this Ordinance is
hereby repealed.
