AN ORDINANCE OF THE GIBSON COUNTY COMISSIONERS ��
ESTABLISHING A GIBSON COUNTY SHERIFF'S OFFICE

WHEREAS, Indiana Code 36-2-13-5 prescribes a county sherifPs powers and
duties. Subparagraph 7 of this statute specifiqlly requires that the sherifPs
office ��take care of the county jail and the prisoners there." The Gibson County
SherifYs Office expends significant time and resources in completing this
statutory duty, which certain persons the Sheriff receives into the county jail
should defray by reimbursing ti�e county;
AND WHEREAS, Indiana Code 36-2-13-15 Indiana Code grants the Board of
Commissioners the authority to adopt an ordinance requiring the County Sheriff
to coliect inmate processing fees;
NOW, THEREFORE, BE ir ORDAINED BY THE GIBSON COUNTY BOARD OF
COMMISSIONERS, that effective the � day of � 2011, tlie sheriff
must assess a processing fee of twenty-five dollars ($Z .00) as an inmate
processing fee for each dme a person is booked into the Gibson County Jail.
The inmate processing fee shall not apply and/or may be waived by the Gibson
County Sheriff in the following instances:

Where the inmate is indigent;
Where the inmate is being held for another agency for a per diem
payment;
Where the inmate is being held for safekeeping for another agency.
IT IS FURTHER ORDAINED that the inmate processing fee shall be collected
before the inmate is released from the Gibson County Jail or the fee shall be
deducted from the inmate's trust account. If an inmate dces not have sufficient
funds prior to their release, the Gibson County Sheriff may defer payment to a
later date. If this deferred payment is not made the deiinquent fee shall be
collected from the inmate's trust account if and when the inmate is retumed to
the Gibson County Jail for any subsequent charges. It shall be the duty of the
Gibson County Sheriff's Office to collect the twenty-five dollars ($25.00) inmate
processing fee.
IT IS FURTHER ORDAINED that the Gibson County Board of Commissioners does
determine that a need e�cists for the creation of a fund whereby all proceeds
received by the Gibson County SherifPs Office for the inmate processing fee shall

be deposited in the Gibson County Inmate Processing Fund. Appropriations from
this fund shall be made through requests to tf�e Gibson County Council.
IT IS FURTHER ORDAINED tliat this ordinance shali become effective upon its
adoption.
