County Commissioner Resolutions - April 2005:_��.. � � �b3 RESOLUTION 2005-� RESOLUTION OF THE SOARD OF COUNTY COMMZSSZONERS OF GIBSON COUNTY AND THE GIBSON COUNTY COUNCIL REGARDING ADMINISTRATION OF HAVA FUNDS BE �T RESO�VED by t�e Boa�d o� County Commissioners of Gibson Cou��y, �ndiana and �he G�DSOn Coun�y Council as �o1lor�s: S�CTION 1. Subject co �he availability o= Title III requiremenc monies to the county uader the Help America Vote Acc of 2002, no la�er than March 31, 2006, the county will make all nermar.e�t and �emporary improvements to each polling place in order to comply with the polling nlace access�bility s�andards set forth in �ndiana Code 3-11-8, and to tt'ie extent possible, make any addicional improvements idencified in che HAVA oolling place survey �nat are not soecifically required by s�ate or federal law. SECTION 2. The County will submit a repor� �o the Indiana Election Division no later than December2l 2005. Tne report under this SECTION mus� list the polling place accessibz�i�y problems iden�i�ied ia c:�e Survey of polling places and indicate whecher �hese problems have been resoived by �emporary or permanent improvements or whether the polling place has Deen relocated to an accessible facility. If the report indicates that the problems have not yet been resolved, the report must indica�e how �he County will resolve the problem no later than Marcn 31, 2006. The County agrees �o submi� any additional reports repuired by t�e Indiana �lect�on Division until the County reports �nat c�e polling place accessiD=lity requ_rements identified in the Survey have beea resolved. The repor� must be certitied as accurate by majority vote of the county elec�ion board, �ollowing review and opporcunity for written comments to he added to the repor� by the local advisory council described in SECT�ON 4 0� this Resolution. SECTION 3. As o� Dece:nber 31, 2005, eac� polling place will contain at least one (1) voting system to permi� a voter who is blind or visually impaired 'to vo�e privately and independently. SECTION 4. The Coun[y Commissioners will adopt an ordinance to establish a local advisory council comprised of representatives o� �he disabilities communicy and elderly voters to provide assis�ance �o the coun�y _n choosing polling nlaces. The couacil may include any number of ine*.nbers, but musc include at least two (2) representatives o� the disabilities communities or elderly vocers. SECTION 6. The County Council oledges thac ii the obligations incurred by the County co obtain tnis voting syscem have been paid in full or in part as of this date, chat the remai�ing Title III requirement monies and state matching funds will be used to imorove the administration of elections for federal office in tne Councv. S�CTION 7. No later �han tnirty (30) days afcer adoption o= tn_s Resolucion, tne Couaty wi11 establisn a separate non- rever�ing account in which all Ti�le III requirement monies and s�ace matching iunds wi11 be deposited. SECTION 8, Tne Councy agrees �o refund �o the State of indiana no late- than May 1, 2006 a� amount equal to the Title III requirement monies and state ma�ching iunds received by ��e Coun�y if tne Secretary of State o� Indiana and the Co-Directors o° �he Indiana Eiection Division de�ermine on Anril 1, 2006 c'��� the County nas not (1) provided ac least one (1) voting system in eacn po1L ng place of the coun�y no later than December 31, 2005 �o permit a voter who is blind or visually impaired to vote privately and independently in accordance with IC 3-ll-15; or (2) honored one or more of the certifications made by the County in this Resolution regardi.g oolling place accessibility or the permi�ted uses oi chese,funds.
