Gibson County Board of Commissioners 5-17-2011************************************************************************************************ Gibson County Board of Commissioners Regular Session May 17, 2011 ************************************ ************************************************************ The Gibson County Board of Commissioners met on May 17, 2011, at 6:00 PM in the North Annex Meeting Room. Members Present: Bob Townsend, President, Gerald Bledsoe, VP, Alan Douglas, Member, Jim McDonald, County Attorney, Kay Vore, Board Assistant and C.T. Montgomery, Auditor. The meeting was called to order with all present standing and reciting the Pledge of Allegiance. Minutes: The minutes from the May 4, 2011 meeting was approved with a motion from Alan Douglas and seconded by Gerald Bledsoe. Motion passed 3-0. Claims: County General: $ 70,208.06 Courts: $ 1,428.13 Highway: $120,107.91 Sheriff: $ 40,620.81 Payroll: $274,924.39 Gerald Bledsoe made a motion to approve the claims. Alan Douglas seconded the motion and the motion passed 3-0. Old Business: The bids for the Economic Redevelopment Commission Road paving projects have been considered. John Umpleby, County Engineer, told commissioners that he recommended the low bid from Dave O’Mara Contractor, Inc., in the amount of $2,191,742.10. Alan Douglas made a motion to approve the recommendation and forward it to the Economic Redevelopment Commission for consideration. Gerald Bledsoe seconded the motion. The motion passed 3-0. Jim McDonald read the final reading of Ordinance 2011-3 “Inmate Processing Fee”. Gerald Bledsoe made a motion to approve Ordinance 2011-3. Alan Douglas seconded the motion and motion passed 3-0. ORDINANCE 2011-3 AN ORDINANCE OF THE GIBSON COUNTY COMISSIONERS ESTABLISHING A GIBSON COUNTY SHERIFF’S OFFICE INMATE PROCESSING FEE WHEREAS, Indiana Code 36-2-13-5 prescribes a county sheriff’s powers and duties. Subparagraph 7 of this statute specifically requires that the sheriff’s office “take care of the county jail and the prisoners there.” The Gibson County Sheriff’s Office expends significant time and resources in completing this statutory duty, which certain persons the Sheriff receives into the county jail should defray by reimbursing the county; AND WHEREAS, Indiana Code 36-2-13-15 Indiana Code grants the Board of Commissioners the authority to adopt an ordinance requiring the County Sheriff to collect inmate processing fees; NOW, THEREFORE, BE IT ORDAINED BY THE GIBSON COUNTY BOARD OF COMMISSIONERS, that effective the 1st day of July, 2011, the sheriff must assess a processing fee of twenty-five dollars ($25.00) as an inmate processing fee for each time a person is booked into the Gibson County Jail. The inmate processing fee shall not apply and/or may be waived by the Gibson County Sheriff in the following instances: 1.) Where the inmate is indigent; 2.) Where the inmate is being held for another agency for a per diem payment; 3.) Where the inmate is being held for safekeeping for another agency. IT IS FURTHER ORDAINED that the inmate processing fee shall be collected before the inmate is released from the Gibson County Jail or the fee shall be deducted from the inmate’s trust account. If an inmate does not have sufficient funds prior to their release, the Gibson County Sheriff may defer payment to a later date. If this deferred payment is not made the delinquent fee shall be collected from the inmate’s trust account if and when the inmate is returned to the Gibson County Jail for any subsequent charges. It shall be the duty of the Gibson County Sheriff’s Office to collect the twenty-five dollars ($25.00) inmate processing fee. IT IS FURTHER ORDAINED by the Gibson County Board of Commissioners that all funds received by the Gibson County Sheriff’s Office for the inmate processing fee shall be deposited in Gibson County General Fund. IT IS FURTHER ORDAINED that this ordinance shall become effective upon its adoption. This ordinance is hereby adopted this 17th day of May, 2011. Ordinance 2011-2 ORDINANCE ESTABLISHING FEES FOR MEALS FOR GIBSON COUNTY JAIL EMPLOYEES WHEREAS, the Board of Commissioners of Gibson County, Indiana (“Commissioners”) is the executive and legislative body for Gibson County; WHEREAS, 210 IAC 3-1-12 provides for the Gibson County Jail to maintain a full service kitchen to prepare and serve meals to inmates housed in the Gibson County Jail in a manner that is compliant with all local and state health standards. NOW, THEREFORE, BE IT ORDAINED by the Gibson County Commissioners as follows: Section 1. Pursuant to the provisions of I.C. 3-8-10-7, the Gibson County Jail provides meals to inmates at a cost to the County of $2.00 or less for each meal. A. The Gibson County Jail feeds between 100-200 inmates three times a day seven days a week, including weekends and holidays. B. The Gibson County Jail must maintain full control over the jail, housing 100-200 inmates at all times, including weekends and holidays. C. In order to maintain the security of the jail and dispatch center it is impossible for all employees to be able to take a 30 minute lunch breaks, as is provided for in the Gibson County Employee Handbook. D. By virtue of cooking for a large number of inmates per day, there are regularly small amounts of “leftovers” that are presently being discarded. WHEREAS, the citizens of Gibson County, Indiana, will benefit by the establishment of an “Gibson County Jail Employee Meal Fee” reimbursement program; and WHEREAS, the “Gibson County Jail Employee Meal Fee” will help defray the costs of meals for prisoners in Gibson County, Indiana by providing meals to employees who are assigned to work in the Gibson County Jail and Dispatch Center, at a cost of $2.00 each. WHEREAS, the Council has the authority under the Indiana Code, including, but not limited to, the Indiana Home Rule Act I.C. §36-1-3-1, et. seq., to establish and authorize the “Gibson County Jail Employee Meal Fee”. NOW, THEREFORE, it is ordained by the Gibson County Commissioners of Gibson County, Indiana, that: Section 1. The Sheriff is hereby authorized to charge a fee of Two & no/100 ($2.00) Dollars per meal for an employee to be provided a meal while on duty at the Gibson County Jail. The “Gibson County Jail Employee Meal Fee” shall be collected prior to receiving meals, and shall be deposited monthly into the County General Fund. Section 2. The “Gibson County Jail Employee Meal Fee” shall be payable by the employee prior to receiving meals. There shall be no charges incurred or credit given to employees for meals. Section 3. The Gibson County Sheriff shall provide for a complete and accurate accounting of all “Gibson County Jail Employee Meal Fee” proceeds and compliance with any reporting or recording requirements as set forth by the Indiana State Board of Accounts. ADOPTED AND PASSED this 17th day of May, 2011 by the Gibson County Commissioners. The final reading will be at the next commissioner’s meeting on June 7, 2011. New Business: Dan Alvey submitted a request for an employee’s three week paid medical leave. Gerald Bledsoe made a motion to approve the request. Alan Douglas seconded the motion and the motion passed 3-0. Juanita Beadle, County Assessor, requested the appointment of Cathy Williams and Kim Minkler to the 2011 Gibson County Property Tax Assessment Board of Appeals (PTABOA). Alan Douglas made a motion to approve the request. Gerald Bledsoe seconded the motion and the motion passed 3-0. County Surveyor, Michael Stevenson, told commissioners that he is required to submit an annual Ditch Certification to them. He also requested, pursuant to Indiana Code 36-2-12-15(c), the Commissioners’ approval to collect four (4) dollars per mile of regulated drain certified. This money is already in the 2011 Drainage Board budget and will not require an additional appropriation. The County has a total of 364.24 miles of regulated drains. Alan Douglas made a motion to approve the request and Gerald Bledsoe seconded. The motion passed 3-0. Sheriff Captain Tim Bottoms presented a HVAC contract agreement, for the Gibson County Jail and Detention Center, between Midwest Mechanical Services, Inc. and the Gibson County Commissioners. The agreement states “Four (4) preventive maintenance service and inspections to be completed per year. This agreement price is $9,842.00 per year, payable $2,460.50 upon completion of the service inspections.” Gerald Bledsoe made motion to accept the contract agreement. Alan Douglas seconded the motion and the motion passed 3-0. Highway Superintendent Jerry Heldt presented the commissioners a Memorandum of Understanding (MOU) between Gibson County and INDOT concerning the closure of State Road 168. A new bridge will be constructed over I-69 and a detour will be on CR 550E and CR 550S. The closure will begin on June 27, 2011 and will re-open on November 27, 2011. The Indiana Department of Transportation agrees to reimburse Gibson County for costs related to damage repair on the listed Official detour. Gerald Bledsoe made a motion to approve the agreement. Alan Douglas seconded the motion and motion passed 3-0. True Rx CEO Nathan Gabhart, presented commissioners a “Prescription Claims Analysis” and how they can save the county $24,329.22 over what they are now paying for drug prescriptions. He stated that clients can use any commercial pharmacy to secure their prescriptions and retail “90 Day Supplies” are available. Co-pays will remain the same for monthly and 90-day supply. They will print the membership cards. After the discussion, Alan Douglas made a motion to accept the change of providers to True Rx. Gerald Bledsoe seconded the motion and motion passed 3-0. County Engineer, John Umpleby told commissioners that the train overpass on Brumfield Avenue, in Princeton, IN had some de-laminating issues on the deck of the bridge. He recommends hiring Bernardin-Lockmueller Associates (BLA) to do a chain test on the integrity of the deck of the bridge. The cost to the county would amount to $2,500.00. The testing will begin on this Thursday and Brumfield Avenue overpass will be closed from 9-11:00 AM. Gerald Bledsoe made a motion to approve the testing by BLA. Alan Douglas seconded the motion and the motion passed 3-0. Alan Douglas made a motion to adjourn.
