Gibson County Board of Commissioners 12-6-2011****************************************************************************** Gibson County Board of Commissioners Regular Session December 6, 2011 ************************************************** **************************** The Gibson County Board of Commissioners met on December 6, 2011, at 8:30 AM at the North Annex Meeting Room. Members Present: Bob Townsend, President, Gerald Bledsoe, VP, Alan Douglas, Commissioner, Kay Vore, Administrative Assistant, Jim McDonald, County Attorney and C.T. Montgomery, County Auditor. The Pledge of Allegiance to the Flag was recited and led by Bob Townsend. Minutes: The minutes from the November 15, 2011 meeting was approved through a motion by Alan Douglas and seconded by Gerald Bledsoe. Motion passed 3-0. Claims: County General: $ 89,393.91 Courts: $ 9,757.11 Sheriff: $ 63,893.27 Highway: $123,846.37 Payroll 12-02-2011 $266,003.46 Gerald Bledsoe made a motion to approve the claims. Alan Douglas seconded and motion passed 3-0. Department Reports: Veteran Affairs Barbara Schenks gave her monthly report. Weights and Measures Gary Dawson gave his monthly report. Health Department Cheri Sweeney reported that they are still giving Flu Shots Monday-Friday from 8 AM to 4 PM for $10.00. She also told commissioners that there is an Open House on December 12, 2011, beginning at 4 PM. Highway Department Jerry Heldt informed commissioners that CR 1150 and CR 850 will be closing this week for milling work. Purdue Extension Agent Cathy Boerste handed our booklets covering their Annual Meeting which occurred last week. If anyone has any questions, please call her. Animal Control Services Brenda Foley gave her monthly report. She informed commissioners that they also will euthanize animals at owners request for $25-$45 depending on size of animal. Old Business: County Engineer John Umpleby recommended to the commissioners that they approve the agreement contracts with CSX and Norfolk Southern Railroads concerning the Brumfield Overpass Project. The project is slated to begin March 12, 2012 and end 90 days later. The project will cost the county approximately $850-$950,000.00 to complete. Alan Douglas made a motion to approve the agreements and was seconded by Gerald Bledsoe. Motion passed 3-0. Gerald Bledsoe made a motion to approve the contract with Bernardin-Lochmueller, Associates, Inc., to verify the quality of the work on the Brumfield Overpass Project. Alan Douglas seconded the motion and the motion passed 3-0. Gerald Bledsoe made a motion to approve the advertisement of the bid for the Brumfield Overpass Project. Alan Douglas seconded the motion and the motion passed 3-0. The second reading of the Subdivision Control Ordinance 2011-7 was waived but a discussion followed. Robert Kinkle and Greg Kissel had misgivings about the availability of the Base Flood Elevations and the time it would take to receive them from DNR. Surveyor Stevenson explained that the requisite to show Base Flood Elevations on plats is already a requirement of a past ordinance that allows county residents to qualify for the National Flood Insurance Program. The new ordinance will just be complying with the previous ordinance. An Ordinance 2011-6 defining County Council Election Districts of Gibson County was read. Alan Douglas made a motion to waive the 2nd and 3rd reading and adopt the ordinance. Gerald Bledsoe seconded the motion and the motion passed 3-0. ORDINANCE 2011-6 OF THE BOARD OF COMMISSIONERS OF GIBSON COUNTY AN ORDINANCE DEFINING COUNTY COUNCIL ELECTION DISTRICTS OF GIBSON COUNTY, INDIANA WHEREAS, I.e. 3-11-1.5-38 provides that a County shall establish precincts and divide precinct boundaries. WHEREAS, it appears that in order to comply with the requirements set forth in I.e. 3-11-1.5-38 that it is clearly necessary to establish County Council Districts based on Precinct boundary modifications. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissione rs of Gibson County, Indiana as follows: The county shall be divided into four (4) districts as follows: Council District 1 shall consist of: Center Township, All Precincts; Patoka Township, Precincts 1, 6, 7, 8 and 13; Washington Township, All Precincts; White River Township, All Precincts. Council District 2 shall consist of: Patoka Township, Precincts 2, 3, 4, 5, 9, 11, 12, 14 and 15; Union Township, Precinct 2. Council District 3 shall consist of: Barton Township, All Precincts; Columbia Township, All Precincts; Union Township, Precincts 1, 3 and 4. Council District 4 shall consist of: Johnson Township, All Precincts; Montgomery Township, All Precincts; Wabash Township, All Precincts. BE IT FURTHER ORDAINED, that a copy of this Ordinance be filed with the Clerk of the Circuit court of Gibson County, Indiana. This Ordinance shall be in full force and effect upon its adoption. ADOPTED THIS 6th DAY OF December1 2011 BOARD OF COMMISSIONERS OF GIBSON COUNTY, INDIANA  GERALD BLEDSOE ATTEST: (SEAl) c. .N\ Somerville resident Steve Bottoms commented that CR 1150 coal mine crossing had over 4 inches of mud on it Sunday and asked why the ordinance wasn’t being enforced. When asked what he would do to correct the problem, he suggested putting some gravel on the mud to help the problem. Commissioners will take it under advisement. Darlene Cromer commented that CR 850 run around was not wide enough for two lane traffic. Jerry Heldt will look at it today to determine its status. New Business: The annual Highway bids for Gasoline and Diesel fuel were opened. Synenergy Partners, LLC, was the only bidder. Diesel Fuel (On Road) $3.54 per Gallon (Off Road) $3.39 per Gallon (#1 Dyed) $3.65 per Gallon (Escalator Clause applies) On Road bid includes State Excise Tax of $ .16 per gallon and State Inspection fee of $ .01 per gallon as required. Off Road does not include any additional tax. Gasoline 89 octane $3.30 per gallon Gasoline 87 octane $3.27 per gallon Prices will start January 1, 2012, and go until June 30, 2012. Gerald Bledsoe made a motion to accept the bids. Alan Douglas seconded the motion and the motion passed 3-0. Bids for Sand and Gravel, Stone, Corrugated Metal Pipe and other Drainage and Bituminous Materials were opened and read and the bids will be taken under advisement and recommendations will be made at the next meeting. Gerald Bledsoe made a motion to take the bids under advisement. Alan Douglas seconded the motion and the motion passed 3-0. Wayne Sharp has resigned from the Owensville Library Board and the Board is recommending that Margo English be appointed to fill out the remaining term to January 1, 2013. Gerald Bledsoe made a motion to approve the recommendation. Alan Douglas seconded the motion and the motion passed 3-0. Gerald Bledsoe made a motion to approve the proposed commissioner meeting calendar for 2012. Alan Douglas seconded and the motion passed 3-0. Quarantine rules after an animal has bitten someone has been added also. The second reading will be on December 27, 2011 at the next commissioners meeting. Sheriff Ballard made a request for a 12 week FMLA for one of his employees. Alan Douglas made a motion to approve the request. Gerald Bledsoe seconded the motion and the motion passed 3-0. Sheriff Ballard made a request to appoint Debra Ferguson to the Community Corrections Board. Alan Douglas made a motion to approve the request. Gerald Bledsoe seconded the motion and the motion passed 3-0. Gerald Bledsoe made a motion to adjourn and Alan Douglas seconded.
