John W. Ballard, being first duly sworn, upon his oath,
deposes and says:
That he is fifty (50) gears of age, is a resident of Princeton,
Gibson County, Indiana, and that he is by orofession an Attorney
at Law with his office located at Princeton, County and State
aforesaid.
Affiant further states that he was we11 acquainted with one
WilLiam Anderson during his lifetime, and that his attention has
been called to a certain Decree in Partition dated March 23, 1949,
and now of record in Civil Order Book No. 107 page 273, Office
of the Clerk of the Gibson Circuit Court and which said Decree was
duly recorded and is now of record in Partition Record 4, page 287,
Office of the Recorder of Gibson County, Indiana, and which said
Decree embraces the following described real estate situate in
Gibson County, State of Indiana, to-wit:
Tract (A): All of the northeast quarter of section
(6), township (3) south, range (10) west, excepting
(65) acres off the south end thereof, and containing
in said tract (88) acres, more or less.
Tract (B): All the northwest quarter of section (6),
township (3) south, range (10) west, excepting (20)
acres off the north end thereof, and containing in
said tract (140) acres, more or less;
Tract (C): All that part of the northeast quarter of
section (1) township (3) south, range (11) west, lying
east of the right-of-way of the Chicago and Eastern
Illinois Railroad Company, excepting (8) acres off the
north end of said part, and containing in said tract
40.25 acres, more or less.
Said Tracts A-B and C, containing 268.25 acres, more or
less; -
among others
And, wherein the court made� the following finding of fact and rendered
its judgment and decree, as follows:
"a. That william Anderson is the owner of an undivided 22/70ths
part thereof in value together with a--iife estate in an additional
7/70ths undivided part thereof in value:"

This affiant further states that he knows of his own knowledge
that the aforesaid �ailliam Anderson designated in said Decree of
Partition and as the owner of an undivided 22/70ths part thereof in
value together with a life estate of 7/70ths undivided part thereof
in value, died testate a resident of Gibson County, Indiana, on
or about March 18, 1962 and that decedent's estate is being admin-
istered in the Gibson Circuit Court under Estate Dkt. P.R. No. 62 -
34 . '
