AFF[DAVIT OF SURVIVORSHIP
CO��fES NOW �Vanda J. Armstrong, who beine first duly s�vom upon her oath, and for
the purpose of clarifyin� tide to the real estate described below, deposes and says:
Jerry L. Armstrong and �Vanda J. Armstrong were duly married on December 8,
1967; and their marriage was continuous and uninterrupted from the date of their marriaee until
the date of ]erry L. Armstrong's death on December 4, 2007.
2. During their marriage Jerry L. Armstrong and �Vanda J. Armstrone took tide as
tenants by the entirety, and continued to hold such real estate as husband and wife until his death
on December 4, 2007, to the follo�ving parcel of real estate located in Gibson County, Indiana:
� A part of the I�'orth Half of the Southeast Quarter of Section 18, Township 1
Sou[h, Range 9 West in Washineton Township, Gibson County, Indiana and
further described as follows: Begin at a spike set in the north line of the southeast
quarter of Section 18, Township 1 South, Range 9«'est and being 807.94 feet
west of the northeast corner thereof; thence measure south 2 degrees 48 minutes
34 seconds West, along an old fence and tree line, a distance of 1321.20 feet to a
�/8 inch iron and T-Post set in the south line of the northeast quaRer of the
southeast quarter of said section 18; thence measure north 89 degrees 34 minutes
57 seconds �vest, a distance of 546.10 feet to a 2 inch pipe found at the southeast
comer of said quarter, quarter section; thence measure north 89 deerees 17
minutes 1� seconds west, alone the south line of the nortfivest quarter of the
southeast quarter of said section 18, a distance of 406.18 feet to a 5/8 inch iron
and T-Post set; thence measure noRh 2 degrees 36 minutes 16 seconds east, a
distance of 1315.13 feet to a spike set in the north line of the southeast quarter of
said section 18; thence measure south 89 degrees 48 minutes 32 seconds east, a
distance of 957.24 feet to the point of beginning and containing 28.881 acres.
EXCEPTII`'G THEREFROM AND RESERVING TO THOMAS �l'. PAULEY
AND FRIEDA PAULEY all their right, title and interest in an undi��ided one-halF
(1/2) interest �in the oil, gas, coal and other minerals underlyine the within
conveyed real esfate, for the term of the natural lives of Thomas �V. Pauley and

Frieda Pauley and the survivor of them, after which lives said undivided one-half
(1/2) interest shall revert to the then owner of the real estate conveyed hereby,
except that in [he event oil, gas, or other minerals are then being produced from
the real estate conveyed hereby or real estate with which it is pooled or unitized or
coal is then being mined from the real estate conveyed hereby or the real estate
conveyed hereby is leased for coal and advanced or earned royalties are then
being paid or deferred by the terms of a coal lease, then in that event the said
undivided one-half (1/2 interest shall pass to the heirs of Thomas W. Pauley and
Frieda Pauley until such time as the production of oil, eas coal or other minerals
from the wi[hin conveyed real estate shall have ceased and payment of coal
royalties both advanced and eamed have ceased or the coal lease has expired,
which ever is later, and at �vhich time said one-half (1/2) interest shall then revert
to the then o�timer of the within conveyed real estate.
SUBJECT TO all other existing rights-of-way, easements, conditions, covenants
and restrictions of record, and also to applicable zoning laws.
3. The Deed to the above-described propeRies was recorded in the Office of the
Recorder of Gibson County.
4. Jerry L. Armsirong died intestate, and left no real estate, interest in real estate,
proceeds of insurance or oiher property, which would make it subject to Federal Estate Taxes.
