Chester L. Bratton, being first duly sworn upon his oath,
deposes and says:
1. That he is a competent adult.
2. That he has personal knowledge of the matters stated
herein.
3. That he is the surviving spouse of Phyllis J. Bratton,
who died a resident of Gibson County, Indiana, on or about the
lOth day of April, 1994.
4. That there were no proceedings for the administration of
an estate for Phyllis J. Bratton and none are contemplated; and
that no liability for Indiana inheritance tax or federal estate
tax was created at the death of Phyllis J. Bratton.
5. That at the time of the death of Phyllis J. Bratton,
Phyllis J. Bratton was the owner, of the following described real
estate in Gibson County, Indiana, to-wit:
The East Half of the West Half of Fractional Section 5,
Township 4 South, Range 11 West, containing 40.62
acres.
(hereinafter the "real estate").
6. That Phyllis J. Bratton died testate, and her Last Will
and Testament was admitted to probate in the Gibson Circuit Court
on the Znd day of June, 1994. Pursuant to the terms of the
Last Will and Testament of Phyllis J. Bratton, she devised and
bequeathed her entire estate to this affiant as her surviving
spouse.
7. That pursuant to the terms of the Last Will and
Testament of Phyllis J. Bratton, title to the real estate vested
in this affiant, and the Auditor of Gibson County, Indiana, is
requested to show transfer of the real estate to this affiant on
the transfer records of the Auditor's Office in said County
pursuant to this Affidavit.
8. That tax duplicates should be sent to Mr. Chester
Bratton, R. Rt. 1, Cynthiana, Indiana 47612.

operation of law at the death of Phyllis J. Bratton, and the
Auditor of Gibson County, Indiana, is requested to show transfer
of said real estate to this affiant on the transfer records of
the Auditor's Office in said County pursuant to this Affidavit.

County, Zndiana, andlfurther described as follows: Begin at an
irbn in the north line of the Northwest Quarter of the Southwest
Quarter of said Section 32, which iron is 359.60 feet east of the
northwest corner of the Quarter, quarter Section; measure thence
east, along said north line 209.25 feet to an iron; measure thence
south (deflection angle right 92 degrees 08 minutes) a distance of
993.33 feet to an iron; measure thence west (deflection angle righ
89 degrees 54 minutes) a distance of 209.25 feet to an iron in the
center of the J.P, Emerson Road; measure thence north (deflection

AFFIDAVIT FOR TRANSFER OF
REAL ESTATE ON AUDITOR'S RECORDS
Chester Bratton, being first duly sworn upon his oath,
deposes and says:
1. That he is a competent adult.
2. That he has personal knowledge of the matters stated
herein.
3. That Virgil R. Emerson, of Gibson County, Indiana, died
testate on January 19, 1980. Pursuant to the terms of his Will,
he devised certain real estate in trust to Phyllis Bratton,
Trustee, for the life of Phyllis Bratton and Chester Bratton.
4. That at the conclusion of proceedings for
administration of the estate of Virgil R. Emerson, a Personal
Representative's Deed was executed and delivered by Phyllis
Bratton, Personal Representative of the Estate of Virgil R.
Emerson, to Phyllis Bratton, Trustee of the Testamentary Trust
created by the Last Will and Testament of Virgil R. Emerson, for
the purpose of transferring title to the real estate so devised
from the Estate to the Trust.
5. That Phyllis Bratton died on April 10, 1994, while
serving as Trustee of the Testamentary Trust created by the Last
Will and Testament of Virgil R. Emerson.
6. That at the time of the death of Phyllis Bratton, the
following described real estate in Gibson County, Indiana was
titled in the name of Phyllis Bratton, Trustee of the
Testamentary Trust created by the Last Will and Testament of
Virgil R. Emerson:

made a part hereof by reference.)
(hereafter "Real Estate").
7. That pursuant to the terms of the Last Will and
Testament of Virgil R. Emerson, this affiant, Chester Bratton,
was named to serve as successor Trustee of the Testamentary Trust
created by the Last Will and Testament of Virgil R. Emerson in
the event of the death of Phyllis Bratton.
8. That this affiant, Chester Bratton, has assumed the
duties of Successor Trustee of the Testamentary Trust created by
the Last Will and Testament of Virgil R. Emerson. Such trust is
undocketed.
9. That the Auditor of Gibson County, Indiana, is
requested to show transfer of the title to said Real Estate from
"Phyllis Bratton, Trustee of the Testamentary Trust created by
the Last Will and Testament of Virgil R. Emerson" to "Chester
Bratton, Successor Trustee of the Testamentary Trust created by
the Last Will and Testament of Virgil R. Emerson".
10. That tax duplicates should be sent to Mr. Chester
Bratton, Successor Trustee, R. Rt. 1, Cynthiana, Indiana 47612.
