ACCOUNT, PETITION TO ALLOW ACCO , AN
FOR ORDER APPROVING DISTRIBUITON AND CLOSING ESTATE
This cause came on to be heard this 12th day of May, 1994,
upon the Co-Administrators' Final Account, Petition to Settle and
Allow Account And For Authority to Make Distribution filed by
Barbara L. Gottfriedt and Charles R. Nixon, Co-Administrators of
the Estate of Charles Roy Burton, Deceased, which Account and
Petition are in the words and figures following, to-wit: (H.I.)
And it appearing that no objections were filed thereto and
the Court being duly advised in the premises now finds:
1. Due notice of the filing of said Account and Petition
and of the hearing on the same was given to all persons
interested in said estate and the same are now properly before
the Court for final action thereon.
2. That the said decedent died intestate, a resident of the
County of Gibson, State of Indiana, on the Sth day of January,
1993; that on the 31st day of March, 1993, this.Court appointed
Barbara L. Gottfriedt and Charles R. Nixon, Co-Admi.nistrators and
Letters of Administration were thereupon issued. Since that
date, they have continued to serve in such capacity.
3. That the matters and things stated in said Account anu
Petition are true and that said Co-Administrators have accounted
for all assets in said estate coming into their hands.
4. More than five (5) months have elapsed since the date of
the first published notice to the legatees, devisees and
creditors of said decedent; that all claims filed against said
estate have been paid and discharged; that neither the decedent
nor this estate were employers of labor within the meaning of

that term as used in the Indiana Employment Security Act; all
estate taxes, inheritance taxes and gross income taxes, if any,
assessed in said estate have been paid.
5. That there are attorney's fee and expenses due Charles
R. Nixon, Attorney for the Estate of Charles Roy Burton,
Deceased, in the amount of $2,066.15. That the cash remaining in
the checking account after paying expenses, except the attorney's
fee and expenses, was $74.90 which sum has been paid towards the
attorney`s fees and expenses leaving a balance due and owing of
$1,991.25. That the balance of $1,991.25 shall be paid out of
the farm rental income on the twenty (20) acre tract herein
described. That all of the rental income from the twenty (20)
acre tract, except an amount to pay the real estate taxes and
assessments and insurance, shall be paid to Charles R. Nixon
until the attorney's fee and expenses are paid in full. That the
rental income on the twenty (20) acres should continue to be paid
to Barbara Gottfriedt until the attorney fee is paid.
6. That at the time of the decedent's death, he owned the
following described real estate:
20 acres off of the North side of the Northeast
Quarter of the Southwest Quarter.
which was not disposed of during the administration of this
Estate. Said real estate descended to the following persons in
the interest shown as tenants in common:

7. That pursuant to Paragraph 5 of the Final Account, there
is no balance for distribution.
IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court
as follows:
1. Said Final Report and Account of said Co-Administrators
is hereby in all things approved, settled and confirmed.
2. That the real estate belonging to the decedent at the
time of his death shall descend to the following persons in the
interest shown as tenants in common:

3. That the balance of the attorney's fees and expenses due
and owing Charles R. Nixon in the amount of $1,991.25 shall be

and assessments and insurance, shall be paid to Charles R. Nixon
until the attorney's fee and expenses are paid in full. That the
rental income on the twenty (20) acres should continue to be paid
to Barbara Gottfriedt until the attorney fee is paid.
4. That said Co-Administrators are hereby directed to file
their Supplemental Report showing that they have complied with
the terms of this Order and that said Co-Administrators have in
all things carried out t e provisions of this final decree.
