Mary Alice Bertram, being duly sworn upon her oath, says that Charles J. Bertram
died intestate on the 29th day of June, 1999, and that said decedent was on the day of his
death the owner, as tenants by the entireties �i�ith Affiant, wife of the decedent, of the
following described real estate in Gibson County, State of Indiana, to-wit:
A southeast part of the northeast quarter of the southwest quarter of Section
35, Township 2 south, Range 11 west, in Patoka Township, Gibson
County, Indiana, and further described as follows: Begin at an iron bar
marking the southeast corner of the northeast quarter of the southwest
quarter of Section 35, To�vnship 2 south, Range 11 �vest, and bear west,
along the south ]ine of said quarter quarter section, a distance of 813.90
feet to an iron at a property fence corner; thence bear north, along the
common Hollis-Ward property line, 258.00 feet to the center line of Lateral
#2 of the Brown Drainage Ditch; thence bear north 59 degrees 03 minutes
east, more or less, up the center of said Ditch, a distance of 87.00 feet,
more or less, to a bend; thence bear north 31 degrees 15 minutes east, more
or less, up the center of said Ditch, a distance of 775.00 feet; more or less,
to another bend; thence bear north 89 degrees 44 minutes east, more or less,
up the center of said Ditch, a distance of 342.00 feet; more or ]ess, to a
point in the east line of the said quarter, quarter section, 353.93 feet more
or less, south of the northeast corner of said quarter, quarter section; thence
bear south 967.98 feet, more or less, to the place of beginning, and
containing 13.839 acres, more or less, but subject to a 50. feet wide ditch
right-of-way off the north edge of the above described tract.
ALSO, an easement and right-of-way for ingress and egress described as
follows: Begin at a point in the north line of the northeast quarter of the
southwest quarter of Section 35, Township 2 south, Range 11 �vest, �vith
the northeast point of beginning for said easement being 1129.87 feet east
of the north�vest corner of said quarter,quarter section and from said
beginning point run thence south 354.93 feet; thence �vest 40 feet; thence
north 354.93 feet, more or ]ess, to the north line of said quarter quarter
section; thence east 40 feet to the place of beginning.

That said real estate passed to this Affiant by virtue of the ]aws of this state; that
this Affiant was the wife of said decedent, and as such was entitled to a fee simple
