ISABELLE M. BITTNER, bcing first duly swom on oath statcs as follo�vs:
1. Thc undersig�ed is the surviving spouse of Comelius G. Bittner, who died
April 4, 2006, a resident of Gibson County, Indiana. The undersigned and Comelius J.
Bitmcr were husband and wife continuously up until the timc of his dcath.
2. On August 4, 1979, Cornelius J. Bittner and his son (the undersigned's
son, also), Tony Bittner a/k/a Anton C. Bittner, entered into a land contract, as
Purchasers, with Charles J. Bertram and Mary Alice Bertram, husband and wife, of
Vanderburgh County, Indiana, as Sellers. The land contract was recorded in the office of
[he Recorder of Gibson County, Indiana, on August 6, 1979, in Deed Drawer 3, Card No.
2961.
3. The land contract was for the following described real estate located in
Gibson County, Indiana, to-wit:
The Northwest Quarter of the Southwest Quarter of Section Thirty (30),
Township threc (3) South, Rangc nine (9) west, containing forty-seven and
three-fourths acres, more or less.
4. All terms and provisions of the land contract �vere satisfied August l,
1989, but no deed was ever put of record evidencing the transfer of the real estate from
the scllers to thc purchascrs until a deed was executed by Mary Alice Bertram to Tony
Bittner, and from this affiant as Trustce of the Comelius G. Bittncr Trust Agreement
dated March 27, 1996.
5. That all of the consideration fumished for the purchase of the above-
dcscribed real esta[e was provided for and paid by Tony Bittner to Charles J. Bcrtram and
Mary Alice Bcrtram, and that no part of the considcration for the purchase of the above-
described real estate was ever furnished by Comelius G. Bittner.
6. It was the intent of Tony Bittner and Cornelius G. Bittner that Cornelius
G. Bittner entcr into the above-describcd land contract as an accommodation maker only,
and not as a purchaser of the above-described real cstate. It was further the intention of
Tony Bittner and Comelius G. Bittner that upon the satisfaction of all of thc tcnns and
provisions of the land contract, tidc of the above-described real estatc was to be conveyed
to Tony Bittncr and that Comclius G. Bittner would quitclaim any interest that he may
havc as a result of a land contract to Tony Bittncr.
