Cunningham (a single person), residing at R.R.#1, �Hazle.ton', Gibson County, indiana, who being first duly sworn on oath deposes and says: That there is a certain Warranty Deed dated June , 1944, and now of record in Deed Record No. 120 page 118, Office of the Recorder of Gibson County, Indiana, and wherein it designated the grantees in said Deed as "Hallie R. Cunningham and Leland S. Cunningham.as joint tenants with right of survivorship as such, and not as tenants in common", and embraces the following described real estate located in White River Township, Gibson Courity, Indiana, towit: A part of Militia Donation number thirty-two (32); in Township one (1) north, range ten (10) west, and bounded as follows: Beginning at the southeast corner of lot number thirteen (13) in Brown's First Addition to the Town of Hazleton; thence running west along the south line of said lot until it intersects with the Chicago and Eastern Illinois Rail- way, formerly the Evansville and Terre Haute Railroad; thence in a south- westerly course along �.d Railroad to the west line of said Militia Donation number thirty-two (32); thence south on said line until it intersects with the line running east and west between Militia Donation number thirty-two (32) and Militia Donation number thirty-one (31); thence east on said line to the southwest corner of a tract of land here- �ofore conveyed to Emma S. Curtner; thence in a northeasterly course to the place of beginning,,and:containing ten (10) acres, more or less. ALSO, a part of Militia Donation number thirty-two (32), township one (1) north, range ten (10) west, bounded as follows, towit: Seginning at the southeast corner of lot number thirteen (13) in Brown's First Add- ition to the Town of Hazleton; thence south along the line to a rock de- signated in a northwest corner of a tract of.land owned by Emma S. Curtner; thence�east to a rock on the line known as the division line between Gervis Aazleton and Harriett I. Brown in said Militia Donation number thirty-two (32); thence along said line north to'the south side and east of the southeast corner of said Lot number thirteen (13) to the beginning and containing three (3) acres, more or less; This affiant further says that�the.above designated Leland S. Cunningham died on or about May 10,� 1954 and this affiant;�as the aforesaid Hallie R. Clinningham survived him and took title as the surviving joint tenant to the real estate hereinabove described; and, that the estate of the said Leland S. Cunningham was settled in the Gibson Circuit Court under Estate Dkt. No. 1890.
