MEDIATED SETTLEMENT AGREEMENT
Comes now the Plaintiffs, Marlin Keith Fouts and Carol Jean Fouts, in person
and by counsei, L. Matthew Nixon; and comes now the Defendants, D. Jean Gwaltney
and Robert Combs, in person, and by counsel, Leslie C. Shively, and the parties now
agree as follows:
1. The parties agree to divide the area of the easement fairly and evenly and
with said mid-point to be determined by the Parties approximating the mid-point as
disclosed in the Plaintiffs' photograph attached hereto ard made a part of this
agreement. The Parties shall then engage the services of Fred Kuester to establish the

to be performed by Plaintiffs shail be completed within fourteen (14) days after the work

3. Notwithstanding the above provision, the Parties agree that the pear tree
shall remain in its present location and nothing shall be done by Plaintiffs to impair the
health of the pear tree.
4. The Parties shall cooperate with each other to cause the encroachment
area to be spread of record, by a survey, so as to give proper notice.
5. The rock driveway area of the easement shall be utilized by both parties
for the purposes of ingress and egress.
6. In the event the Parties cannot agree as to the easement mid-point; this
agreement shall not be binding on any party.
7. Each party shaii forthwifh prepare, execute and deliver proper documents
of title and/or such additionai instruments as are necessary to carry out and comply with
the terms of this agreement.
8. This agreement may not be altered, changed or modified, except in writing
signed by each of the parties or in any other manner authorized by law.
9. The Parties acknowledge that they are entering into this agreement
voluntarily
10. The provisions of this agreement shall be construed and enforced in
accordance with the applicable laws of the State of Indiana.
11. If any party defaults in the performance of any of the terms,
provisions or obligations herein set forth, and it becomes necessary to pursue legal

proceedings to effectuate the performance of any provisions to this agreement, then the
party found to be in defaulf shall pay all expenses, including reasonable attorney fees,
incurred in connection with such enforcement proceedings.
12. Each party fully understands all of the terms of this agreement, and the
terms represent and constitute the entire understanding between them. Each party
has read this document and finds it to be in accordance with his or her understanding,
and each voluntarily executes this document and a�xes his or her signature.
13. All the covenants, promises, stipulations, agreements and provisions
herein contained shall bind the heirs, executors, administrators, personal
representatives and assigns of the parties hereto.
14. If any provision of this agreement is held to be unenforceable, all other
provisions shail nevertheless continue in fuil force and effect.
