AFFIDAVIT OF TRANSFER OF REAL ESTATE
1. That the above named decedent died intestate on the 25th
day of December, 2005, while domiciled in Gibson County, Indiana.
2. That forty-five (45) days have elapsed since the death of
the decedent.
3. That no application or petition for the appointment of a
personal representative is pending or has been granted in any
jurisdiction.
4. That the following persons are the only heirs, legatees
or devises of the decedent:

5. That the value of the decedent's gross probate estate
less liens and encumbrances does not exceed the sum of Twenty-five
Thousand Dollars ($25,000.00) as provided by I.C. 29-2-8-1,
including costs and expenses of administration and reasonable
funeral expenses. That all known debts of Mary C. Mitchell have
been paid and there are no State Inheritance Taxes or Federal Taxes
due and owing.

6. That the following is a full description of the real
estate belonging to the decedent, and the same was appraised for
$10.000.00.
A part of Lot Number 14 in Mead and Chappel Addition to the Town of
Francisco, Indiana, and more particularly described as follows: The
place of beginning may be found at the Northeast corner of said Lot
Number 14, and run thence South along the East line of said lot;
thence North along the West line thereof 140.30 feet to the
Northwest corner of said lot; thence South 74 degrees OS minutes
East 109.15 feet to the place of beginning. Except the coal
underlying the same.
7. That by reasons of the above stated matter, the Affiants
request that the above encumbered real estate of the decedent, Mary
C. Mitchell, be transferred pursuant to the laws of intestate
succession as provided in Indiana Code.
WHEREFORE, the Affiants herein hereby request that they be
authorized to sell the above described real estate, pursuant to
Indiana Code and that distribution of said property to the Affiants
herein be authorized and they be released from any liability with
regard to the proper application and disbursements of said real
estate.
That the Affiants herein, Kimberly Dorris, Damita Combs and
Timothy Short, hereby charge themselves with the responsibility of
proper disbursement of the funds according to the provisions of the
Zndiana Code, and hereby agree to hold themselves harmless from any
liability with regard to the transfer of the real estate.
