AN ORDINANCE VACATING ALLEY

GIBSON COUNTY A @i�EAS, Ralph Hillyard, Jr. and Linda L. Hillyard pursuant to IC 36-7-3-12
have filed a petition with the To«m Council of the Town of FoR Branch, Indiana, to
aacate a 10 foot alley to the South of Lots 38, 39, 40, and 41 and to the North of Lots 47,
4S, �9, and �0 in the Holcomb Addition to the To���n of Fort Branch;
WI-IEREAS, the alley is a platted 10 foot strip of land to the South of Lots 38, 39,
�30 and =}1 and ro the North of Lots 47, 4S, 49, and �0 in the Holcomb Addition to the
Town of Fort Branch, and the alley is located �+�ithin the corporate limits of the To�vn of
Fort Branch, Indiana (See attached Exhibit "A");
�VHEREAS, the alle}' is not used, is not needed, and ��acation of the alley �vould
not hinder orderly de��elopment of the neighborhood in which it is located or [o �vhich it
is conti�uous, and would not make access to any lands difficult or inconvenient, would
not hinder the public's access to a church, school or other public building or place and
��rould not hinder the use of a public �� ay by the neighborhood in which it is located or to
��hich it is conti�uous;
\t�IIEREAS, there are electric utilitv lines in the platted alley, and in accordance
�. ich IC 36-7-3-16, ��acation of the alley will not deprive the public utilitv of the use of all
or part of the � acated alley, and � acation of the alley will ha��e no effect on any public
utility that has utilities in the vacated alley;
R'HEREAS, To«�n of Fort Branch rese��es an easement for any water or sewer
lines ���ithin the ��acated altey;
\�'HEREAS, a public hearin� has been held on the petition;
�1'FiEREAS, notice of the public hearing on the Petition was published in the
South Gibson Star-Times in accordance with IC 5-3-1-2; And
\1'HEREAS, notice of the public hearing on the Petition ���as gi��en by certified
mail to all o�� ners of land that abut the alley.
NO��' THEREFORE, BE IT ORD.AI\iED by the To�vn Council of the Town of
Fort Branch, as follows:
Section 1: The platted 10-foot alley to the South of Lots 3S, 39, 40, and 41 and to
the \'orth Lots 47, 4S, 49, and �0 in the Holcomb Addition to the To���n of Fort Branch
be, and hereby is; ��acared.
Section 2: In accordance «�ith law, o�vnership of the ��acated alley re��erts to the
abuttin� lot o�vners with the north half of the vacated alley belon�ing to the owners of
Lots 38, 39, 40, and 41 which abut the north side of said vacated alley, and the south half
of the vacated alley belongin� to the owners of Lots 47, 48, 49, and 50 «�hich abut the
south side of the vacated alley, all in the Holcomb Addition to the Town of FoR Branch.
Section 3: In accordance �� ith IC 36-7-3-16, vacation of the allev �vill not deprive
the public utility havin� lines in the vacated alley of the use of all or part of the vacated
alley, and vacation of the alley �vill have no effect on any public utiliry that has utilities in
the vacared aliey.
Section 4: Vacation of the alley �vill not deprive the Town of FoR Branch of the
use of all or part of the vacated alley for any water or se�aer lines located in the eacated
allzy, and the To���n of Fort Branch shall have an easement for any water or sewer lines in
the ��acated alley.
Section �: In accordance wiih IC 36-7-3-12, «�ithin 30 days of thz adoption of this
ordinance, a copy of this Ordinance shall be filed «�ith the Auditor's Office of Gibson
County, Indiana, and a copy of this Ordinance shall be recorded in the Office of Recorder
of Gibson Countv, Indiana.
Section 6: This ordinance shall be in full force and effect from and after the dare
of passage.
