in Gibson County, Indiana, u[ilizing competent tide scarchers familiar with the deed records and
tax transfcr records of Gibson County, Indiana, thc results of �t�hich havc becn tabulatcd and
rcvicwed by counscl familiar with thc historic practiccs and methodolo�y of transferring coal
csta[cs in Gibson County, Indiana, and clsc�aherc in thc rcgon.
4. Bascd upon the tindings of an independcnt tide searcher and independent Icr�al
counsel, IPL has condudcd that the transfer rccord cntryand the tax rocords for IPL do not at the
present timc completcly identify IPL's coal owncrship in �Vashin�ROn Township, To�vnship I
South, Range 9 �'��est. The following are crrors in the transfer rccord and tax records as rccited
abovc:

1/4", in Section 17, Township I, Range 9, is incorrect. Thc exccption should read
as the "E U2 except SW I/4 of the NW I/4 of the NE 1/4" which results in 3l0
acres mstcad of 300 acres as it currendy rcads.

I South, Range 9 West is listed in both the transfcr record entry and in thc tax
record as 2044.73 acres. Based on a calculation of all the acrca��es from the coal
deeds to cither IPL or IPL's predecessors in interest, the actual acrea��c is 2051.4
acres, and should bc corcected accordin�ly.
5. To IPL's bcst kno���lcdge and belief based upon the foregoing, all of thc abo��e
errors in the transfcr record and tax rccords should bc corrected to read as:
