Ballard, an Attorney at Law of Princeton, Indiana, being s'worn on oath deposes and says: 1. That he was personally acquainted with both Mike P. Kiesel and Julia M. Kiesel (formerly husband and wife but now each deceased). 2. That he knows from his examination of a certain deed dated February 21, 1963 and now of record in Deed Record No. 161, page 146, Office of the Recorder of Gibson County; Indiana, that the aforesaid Mike P. Kiesel and Julia M. Kiesel, as husband and wife, reserved for themselves and each of them a life estate in and to the following described real estate.located in Gibson County, State of Indiana, towit: A part of the South One-half (1/2) of the Southeast Quarter (SEa) of Section Twenty-six (26), Township three (3) south, Range Eleven (11) West, described by metes and bounds as follows: Commencing at a�nt in the south line of said Quarter Section a distance of (44) rods West of the Southeast corner of said South Half (1/2) of the Southeast Quarter (1/4) of said Section, Township and Range aforesaid and from said beginning point run thence North (172) feet; thence West (84) feet; thence South (172) feet to a point due west of the point of beginning; thence East a distance of (84) feet, more or less, to the point of beginning. 3. This affiant further says that the aforedesignated Julia M. Kiesel died intestate, a resident of Gibson County, Indiana, on or about April 6, 1964 and left surviving the aforesaid Mike P. Kiesel as her widower; and, that the aforesaid Mike P. Kiesel died testate, a resident of Gibson County, Indiana, on or about November 25, 1967 and that decedent's estate is in the process of administration under the jurisdiction of the Gibson Circuit Court of Gibson County, Indiana under Probate Cause 67 - 131. 4. That upon the demise of each the aforesaid Mike P. Kiesel and Julia M. Kiesel, husband and wife, the life estate as reserved terminated and the title to the above described real estate, free of the life estate of each the said Mike P. Kiesel and Julia M. Kiesel, is under the aforesaid deed, in the name of Elmer L. Kiesel and Dolores P. Kiesel, husband and wife. .. -- � � .. � 5. That this affidavit is made for the purpose of showing the date of death of each the said Mike P. Kiesel and Julia M. Kiesel, husband and wife, and the termination of their respective life estate in the real estate as hereinabove described, all in their order that they may obtain a transfer from �crespective names of said real estate on the transfer books in the Office of the Auditor of Gibson County, Indiana, to Elmer L.
