The undersigned, John W. Ballard, being first duly sworn on oath deposes and says: That he is more than forty (40) years of age and is and has been for a period of more than twenty (20) years last past engaged in the practice of Law at Princeton, Gibson County, Indiana. That he has been employed by one James A. Ladd, residing at No. 20907 Millard Street, Taylor, Michigan, step-son of the above designated Herbert I. Hyde, deceased, to assist in the � settlement of the estate of said decedent. This affiant further states from his examination of the / records it appears that the aforesaid Herbert I. Hyde, died intestate, a resident of Gibson County, Indiana, while a�:patient at the Deaconess Aospital, Evansville, Indiana, on or about May 11, 1968. That the aforesaid decedent, Herbert I. Hyde, as of the date of his demise was the owner of an undivided one-half (1/2) part in value of the following described real estate situate in Johnson Township, Gibson County, State of Indiana, towit: A part of the east half of the southwest quarter, and a part of the southwest quarter of the southwest quarter, all in section 7, township 4 south, range 10 west, bounded as follows: begin in the north line of said half quarter section at a point 30 feet east of the northwest corner thereof, and run thence east along said north line to the west right of way line of the Chicago and Eastern Illinois Railway Company; thence in a southeasterly direction along said right of way line to the south line of said half quarter section; thence west along the south line of said section 7 to'a point 30 feet west of the southeast corner of the southwest quarter of the southwest quarter of said section 7, thence north to the north line of said quarter quarter section; thence east 60 feet; thence north to the ooint of beginning, containing 20.82 acres, more or less. ERCEPTING THEREFROM, the following described partthereof: Part of the Northeast 4uarter of the Southwest Quarter of Section 7, Tawnship 4 south, Range 10 West in Johnson Township, I Gibson County, Indiana, and more particularly described as follows: / 7f . �_ � 1 � - -, The place of beginning may be found at a point on the south line of said quarter quarter 30.00 feet east of the southwest corner thereof, thence east along the south line of said quarter quarter 293.00 feet to an iron on the west 40 foot right of way of the C&EI Railroad; thence North 6 degrees 14' West 1331.55 feet to an iron on the same 40 foot right of way; thence West and along the north line of said quarter, quarter 138.00 feet to a point 30.00 feet east of the northwest corner of said quarter, quarter; thence south and parallel to the west line thereof 1323.68 feet to the place of beginning, and containing 6.5485 acres, and containing after said exception 14.2715 acres, more or less. For chain of title see Deed Record No. 128 page 10.9; Deed Record No. 143 page 58; Deed Record No. 143 page. 59; and, Deed Record No. 164 page 333, Office of the Recorder of Gibson County, indiana. This affiant further says that he is informed and does verily believe that the estate of Aerbert i. Hyde,, deceased, was in a gross of less than Sixty Thousand Dollars ($60,000.00) and that decedent's estate was not subject to a Federal Estate Tax; that the Indiana Inheritance Tax liability of decedent's estate was determined by the Gibson Circuit Court of Gibson County, indiana, in Cause No. PR 68 - 103. This affiant further says that upon the demise of the said Herbert I. Hyde, his entire undivided interest in the aforedescribed real estate became vested in the above designated James A. Ladd as � the surviving joint owner thereof. That this affidavit is made for the purpose of establishing the date of death of the aforesaid Herbert i. Hyde and the survivorship of James A. Ladd in order to obtain a transfer on the Transfer Books of Johnson Township in the Office of the Auditor of Gibson County, Indiana, from the joint names of James A. Ladd and Herbert I.
