JAN 1 0 2008 �� �� GIBSON COUNTY AUDITOR The relative positional acwracy (due to raodom errors in measurements) of the comers of the subjec[ tract established this survey is within Ihe specifications for a RURAL" survey (016 feet plus 200 paru per million) as defu�ed in `Rule 12". There may be differences of deed dimensions versus measured dimensions along the boundary lines shown hereon and, likewise, there may be found survey markers near, but not precisely at, some boundary comers. In cases where the ma�nitude of these differences are less than the Positional Accuracy stated above and less than the uncertainry identified for the reference monumentation (discussed below), [he differences may be considered insignificant and are shown only for purposes of mathema[ical closure. Such differences that are greater [han ihe Positional Accuracy and the uncertainty in reference monumentation should be considered worthy of notice and are [herefore discussed further below. PURPOSE This "Retracement" survey was ordered by Cindy Kissel [o establish the lines and comers of [he proper[y described in Instrument Number 96-2146. The property is located on the North side of State Road 64 at the intersection with County Road 3SOE. The current description of record does not reflect the recent conveyance of 42.80 acres to Chad Begle. Control monumenu for this survey were established on-site by GPS real-time kinematic measurements based on a local coordinate grid established exclusively for this project. All distance measurements shown on the survey aze ground dimensions. This report applies to a survey by A to B Surveying, LLC. under the direct supervision of Brian Resenbeck, R.L.S. Ij c..v,.����,i��.i,:.n:m:q: A right-of-way grant, daced April 4, 1929, (file number 40562) conveys right-of-way from the North right-of-way of the railroad to the Nonherly ri�ht-of-way of State Road 64 as shown on the drawings. In June of 2007, two parcels were prottacted out by survey (and conveyed via lnsvument No. 07-4288 and 07-4289 (graniee: Chad Beele). Deed plots of subject property and adjoining tracts did not reveal any obvious gaps or overlaps. New descriptions based on this surve}' are prepared to re(lect modern surveying dimensions and monumentation (See end of this report). The Uncerlainties in Record Description. none noted. RECORD MONUMENTS Survevs of Record/Called for monuments Survey of adjoining property (Begle property) by Andy Easley Engineering (Don Gries, RLS), dated June 18, 2007. Gibson Counry Corner Records indicate the following comers: FJ4 comer, Section 15 —"irod' — A 1!2" iron pin was found at the N W wmer of a fence post. Remains of an old fence line were noted to the East and West. The iron pin/post falls in the apparent center of an old A'orth/South roadbed as detertnined from dw fence locared along each side of the road along the Eazt line of Section IS. Additional measurements to monumenu at the NE and SE comers of Section 15 indicate that comer is within 4.00' of the midpoint between [he corners. SE comer, Section 15 —`1-1/2" axle over boat spi}:e" — A 1-1/2" 'von pipe waz found and accepted marking this comer. The location of the iroo pipe is consistent with reference tie dimensions provided in the comer records. S/4 comer, Section 15 —"iron ba�' and "o bolY' — A 5/S" iron pin with a 1-l/2" square head u�as found that measures within O.P of the midpoint between monuments at the SE and SW corners of Section 15. Center of Section 15 —"stone" — The stone was located on a 1998 survey by Fred Kuester, RLS and fiuther referenced per the aforesaid Easle}• Engineering survey. El4 comer, Section 22 —"brick and iron rod" — A search of the area did not turn up any evideoce of the monument or the reference ties. The monument most likety was not perpetuated after the cons[ructioo of Counry Road 350E. Center of Section 22 —"srone" — An irregular-shaped stone (approx. 9" x 1 l°) was found and used. The position of the stone is wnsistent with possession in the area. The adjoining tracu (Beard, Deed Drawer 4, card 8958 and Beard Instrument No. 84-5881) cails for S/8" iron pins at the comers and calls the lines along fences. Theon• of Location in [he Establishment o( Lines and Corners The SF/4 of Sec[iou 15 was established using the aforementioned monuments. A"male" sucker rod was found and accepted marking the N W comer of the FJ2, SFJ4, Section 15. The monument is called for in several descriptions in the area and is at the intersection of an old fence line to the E, W and S. The position of the iron is 4.8' N and 3.4' W of the midpoint of the North line of the SEJ4. A 12" iron rod was found at a fence intersection at the SW comer of the E2, SEJ4, Section 15. The iron is called for in descriptions in the area and is consistent with dimensions noted in a legal survey recorded in Surveyor Record Book 3, page 3T . The South lice of Tract 1(25 acres off [he North side, SW/4, SE/4) was accepted using found monuments at fence intersections. The fence is called ou[ in the adjoining Beard descriptions and [he resulting acreage of [iNe tract is considered reasonable. It is my opinion that this follows original inrent and continued use. The Northerly lines of Tract 2 were accepted u established on the Easley survey. The survey depicts a monument at the comer in the roadway; no monumeot was found although wimesses were found as shown on the anached plat. The South line of the W/2, NFJ4, Section 22 was established using the sto�e found at t6e center of Section 22 and a post found at the SE comer. Ao irregular-shaped stone was found lying next to the post and the stone appears that i[ may have been disturbed by the placement of the post. The position of the post was consistent with possession and survey dimensions of rewrd. This alienment was then exte�ded [he same dimension to the East to establish [he position of the Fl4 comer of Section 22. The position is in agreement with surve}' dimensions of record bo[h to the Nor[h and West. The established position of the East line of the NE/4, Section 22 is within O.S of the location as showo on the 1929 road plans. Variations of less than LO' were noted to found right-of-way markers and to structures (box culverts and side roads). Right-of-way was theo established at record offsets. The East line of the Richardson tract was established parallel with the West line of the quarter-quarter at record dimension. The NW comer of �he Richardson [ract was established at record distance (650') from State Road 64 right-of-way. This resulted in the dimension to the commencing corner (NW comer, NE/4, NFJ4) to be 134' short and [he North line of [he Richardson tract to measure 1.31' long. The Uncertarnties in Reference Monuments: 14.0 fee�, 1he variulron benveen the accepted iron pins along the East [ine oj�he I3eurd rract described in Imstrwnent Number 84-5881. L�NES OF OCCUPATION • Old fence lines exis[ along the North and West line of Tract 1 and traces of fence were found along the South iine. • The East line of Tract 2 follows the apparent centerline of an old roadbed. Traces of an old fence line were found approximately 16' on each side of the roadbed abng [he East line of Section 15. • No record easement was found for ingress and egress to the Begle conveyances. The Easley survey pla[ depicts a 30' in�ress/egress and utiliry easement following an existing driveway. As shown on the Eastey survey plat, Clark Read Road has a 30' ro-w per Gravel Road Record Book 3, page 530 al[hough the road terminates at "250 feet North of the Maio Track of Southern Railway°. The roadway is obviously used by ott�ers for access and there is assump$on that a prescriptive easement exists along the section line with a similar right-of-way as the road (30'). • A fence line exis[s aloog [he Northem portion of [he West line of the NF/4, NFJ4, Sec[ion 22. • The East line of Tract 3 follows the general centerline of a roadway (chip and seal surface). • No other lines of occuparion were noted. The Uncertaintres rn Lines of Occupation: A'o obvious inconsistencies were noted along the established lines.
