Barbara J. Martin, being first duly swor upon oath, deposes

1. That she is a competent adult.
2. That she has personal knowledge of the matters stated
herein.
3. That she is the surviving spouse of Byron Martin, Jr.,
who died a resident of Gibson County, Indiana, on or about the
29th day of October, 1989.
4. That there were no proceedings for the administration of
an estate for Byron Martin, Jr. and none are contemplated; and
that no liability for Zndiana inheritance tax or federal estate
tax was created at the death of Byron Martin, Jr.
5. That at the time of the death of Byron Martin, Jr.,
Byron Martin, Jr. was the owner with this affiant, as tenants by
the entirety, of the following described real estate in Gibson
County, Indiana, to-wit:
See Exhibit A attached hereto
and made a part hereof.
(hereinafter the "real estate").
6. That Byron Martin, Jr. and this ffiant were husband and
wife continuously from and after /a��,s �/.�'J
through the date of death of Byron Marti , Jr.
7. That title to the real estate vested in this affiant by
operation of law at the death of Byron Martin, Jr., and the
Auditor of Gibson County, Indiana, is requested to show transfer
of said real estate to this affiant on the transfer records of
the Auditor's Office in said County pursuant to this Affidavit.

TRACT I
The south part of the east half of the southwest quarter of
Section 31, in Township 2 south, Range 11 west and bounded as
follows: Beginning at a stone on the southwest corner of said
half quarter section and run thence north '] chains and 16 links
to a casting; thence east 3$ chains and 11 links to a casting in
the east line of said half quarter section; thence south '7 chains
and 16 links to a casting; thence west to the beginning, except
that part of said described tract lying south and east of road
and bordering on said road there being 4 acres, more or less.

thence bear west square to said east line, a distance of 415.00 feet
to an iron set in place; thence bear south, parallel to the east

way Co. by Warranty Deed dated July 30, 1910, recorded
in Deed Rec. 71, page 347, Office of the Recorder of
Gibson County, Indiana; and FURTHER EXCEPT the foll-
owing described tract: A part of the northeast quarter
of the northwest quarter of Section 15, township 3
south, range 12 west, bounded as follows: Begin at a
point in the northeast quarter of the northwest quarter
of said Section 15, township 3 south, range 12 west,
where the west line of the E4ransville, Mt. Carmel &
Northern Railway Company, as established in 1910, inter-
sects the center line of the public highway, as then
established, approximately 132 feet south of the north
line of said quarter quarter section; thence west 175
feet; thence south 214 £eet; thence east to the west
line of the right of way of said railroad; thence in a
northeasterly direction along the west line of said
right of way to the point of beginning, containning 1
