Tetmne, in person and with Counsel, James G. McDonald, III, and comes also the Respondent-father, Steven A. Teirune, in person and with Counsel, George H. Rehnquist. And the Court having heretofore taken the property settlement under advisement now finds as follows: 1. That this Court has jurisdiction over the subject matter hereof and the parties hereto. 2. That the Petitioner-mother shall have the care, custody, control and education of the parties' minor children subject to Respondent-father's right of reasonable visitation on alternating weekends from Friday 6:00 P.M. to Sunday 6:00 P.M. and alternating Holidays from 9:00 A.M. to 6:00 P.M. In addition, Respondent- father shall have two (2) non-consecutive weeks of visitation with the minor children during the su[mner upon thirty (30) days advance notice. 3. Both parties are committed to quality education and medical treatment of the children. Both parties will discuss any decision regarding medical, schools, colleges, universities, special education needs, counseling or tutoring with each other and/or with the child. 4. That the Respondent-father shall pay child support to the Petition2r-mother in the sum of One Hundred Ninety-nine Dollars ($199.00) per week into the Clerk of the Gibson Superior Court beginning Friday, March 5, 1999, and each and every Friday thereafter. That the above ordered child support is in accordance with the Indiana Child Support Guidelines as shown by the worksheet attached hereto and marked Exhibit "A". 5. That the Respondent-father shall maintain his health insurance on the minor children through his employer. That the Petitioner-mother shall be responsible for any co-payment required by the Respondent-father's health insurance. That the parties � 9. That the Respondent-father shall be the sole and absolute owner of his 401 (K) Savings Plan and pension at his previous employer, United Mine Workers of America. The Petitioner-mother waives any right, title and interest or claims she may have in said 401 (K) Savings Plan and Pension. 11. That the parties shall file a joint tax return for 1998 and divide any and all refund from the State of Indiana and Internal Revenue Service with Petitioner-mother receiving one-third (1/3) and Respondent-father two-thirds (2/3). 12. That the Respondent-father shall be allowed Y.o claim as dependents on his federal and state income tax returns beginning in the tax year 1999, Summer and Kyle. 13. That the Petitioner-mother sl�all be allowed to claim as dependents on her federal and state income tax returns beginning in the tax year 1999, Haley. 14. Respondent-father shall maintain his present life insurance policies and designate the parties' minor children as beneficiaries. 15. The parties agree to allow the Respondent-father to have possession of the Van. The Respondent-father shall make reasonable effort to sell the Van to pay off the note due to Citizens National Sank and divide evenly any other proceeds. If the Van is not sold within ninety (90) days, Respondent-father shall refinance said Van loan out of the Petitioner-mother's name and the Van shall be his property. / 16. That the Petitioner-mother shall have her name resto to Terri L. Meeks. 17. Each of the parties hereto agree uments necessary to eifectuate and carry out the terms and provisions of this Property Settlement Agreement. 18. Respondent-father shall pay and be responsible for the martial home utilities incurred in February, 1999, payable in March, 1999. He shall also pay the sum of $71.44 to Petitioner- mother for his pro-rata share of the house mortgage for the month of March, 1999. � _ SO ORDERED THIS � DAY OF �
