Sharon J. Grabert, being first duly swom upon her oath, says:
1. Affiant is Assistant Vice President and Trust Officer of Fifrh Third Bank
(Southem Indiana), successor in interest to The Citizens \iational Bank of Evansvil(e, as Trustee
of The Arvid N. �font�omery Trust, dated i�fay 16, 1977, as amended.
2. Cora A. �iontgomery died on December 16, 1983, and her Last -�Vill and
Testament was probated in the Gibson Circuit Court, Cause Number PR-83-137. By ��iRUe of
said Will, any interest Cora A. Yiontgomery owned in the real estate described below was
devised to �.rvid N. Vfontgomery upon her death.
3. Arvid N. Montgomery died April 20, 1955, and at the time of his death he o�vned
the follo�ving described real estate located in Gibson County, Indiana:
Tract 1: (Tax Code Number 00�-0 1 1 8 1-001
The Nonh %z of the Southeast % of Section 36, Township 3 South, Ran�e 12
West, in Gibson County, Indiana, LESS the follo�ving described paR thereof
conveyed to Steven A. Mont�omery by deed dated June 7, 1982, and recorded in
Drawer \TO. 4, Card \io. 11,343 in the office of the Recorder of Gibson County,
Indiana, to-wit:
Beginning at a railroad spike on the West line 23� feet South of an iron mazking
the Northwest comer of said north half; [hence east and pe:pendicular to said west
line 21 � feet ro an iron; thence south and parallel to said west line 300 feet to an
iron; thence west and perpendicular to said west line 21� feet to a railroad spike
on said west line; thence north along said �vest line 300 feet to a railroad spike at
the point of be�inning, and containing in said exception 1.48 acres, more or less.
Tract 2: (Tax Code Number OU-000�4-00 and OU-003�d-001
Part of Lot 4i in the Ori�inal Plan of the Town of O«�ensville, Indiana, and
bounded as follows:

Also, all of Lot 41 and Part of Lot 48 in the Original Plan of the town of
Owensville, Indiana, and together bounded as follows:
Beginning at the northeast comer of said Lot 41 and running thence south and
along the east line thereof 130.� feet to a point in the east line of said Lot 48;
thence west and parallel to the north line of said Lot 48 a distance of 148.� feet to
a point in the west line of said Lot 48; thence north along said west line a distance
of 180.5 feet to the north�vest comer of said Lot 41; thence east along the north
line of said Lot 41 a distance of 143.� feet to the point of beginning.
4. Affiant fuRher states that Arvid N. Vfont�omery's Last Will and Testament was
probated in the Gibson Circuit Court, Caese No. PR-85-50. In his Last R'ill and Testament,
Arvid N. Montgomery devised ali of the above-described real estate to The Citizens National
Bank of Evansville, now known as "Fifth Third Bank (Southem Indiana)", as Trustee of The
Arvid N. Montgomery Trust dated i�tay 16, 1977.
5. Affiant further states that this Affidavit is made for the purpose of inducing the
Auditor and Treasurer of Gibson County, Indiana, to transfer on the records of Gibson County,
Indiana, the above-described real estate to:
