NIEMEIER, (Affiant") being first duly sworn upon his oath, deposes and says: 1.. The Affiant has personal knowledge of all matters contained herein,'-�nd the Affiant is in all other respects competent to testify as to the matters contained herein. 2. That Affiant is owner of the following described real estate ;"Real Estate") lo�ated in Gibson County, Indiana, to wit: A part of the Northeast Quarter, Southeast Quarter of Section 36, Township 3 South, Range 11 West, being also the South 35 feet off of Lot 35 and the North 55 feet off of Lot 34 of First Addition to West Heights Subdivision to the Town of Haubstadt, Indiana, and recorded September 20, 1955, in Plat Record Book 2, page 67, Gibson County Recorder's Office and further described as follows: Begin at the Northeast corner of Lot 34 of First Addition to West Heights Subdivision to Haubstadt, Indiana, and run South along the East line of said Lot 34 for 55 feet; thence run West parallel to the North line of said Lot 39 for 125 feet to the west line of said lot; thence run North along the West lines of Lot 34 and 35 for 90 feet; thence run East parallel to the South line of Lot 35 for 125 feet to the East line of said lot; thence run South for 35 feet to the place of beginning and containing 0.258 acres. Being the same real estate described in Deed Record No. 160, page 175, Office of the Recorder of Gibson County, Indiana. 3. Affiant represents and warrants that he is the widower of nnnnTuy E. NIEMEIER, deceased (the "Decedent"), named as co-grantee in a conveyance of the above described Real Estate, dated January 11, 1966, and recorded on January 24, 1966, in Deed Record 168, page 281, in the office of the Recorder of Gibson County, Indiana; that the Decedent departed this life, intestate, on December 7, 1985, a resident of Gibson County, Indiana; that the Decedent and the GRANTOR herein were husband and wife continuously from their acquisition of the Real Estate until the death of the Decedent; that the estate of the Decedent, including jointly held property, insurance proceeds and all gifts in contemplation of death, was not of sufficient size to be subject to any federal estate tax.
