The terms and conditions under which the demised premises are leased are as follows: ]. The term of this lease shall be one year from the date hereof to,ether with the right of the lessee to renew the same from year to year thereafter upon the same terms proyided that lessee has complied with all tlie terms of this agreement and is not in default in any of the provisions herein. Tliis lease may be renewed by lessee by the payment of the annual rental within thirty (30) days after the anniversary date hereof and such extension shall be evidenced by endorsement on this contract and siened by the par4es hereto. If [he lease has been renewed each year as herein provided, beginning with the renewal for the year 1975 and every fifth year thereafter, the parties hereto shall have the right to renegotiate the terms and provisions of this lease taking into consideration the economic trends and conditions then existin�; provided, however, that no increase in rental shall exceed ten (10%) percent of the rental provided for the original term of this lease. 2. Lessee covenants and agrees that demised premises shall not be used for commercial or business pur- poses but shall be used by him for recreational purposes only. 3. It is understood and a�reed by and between the parties hereto that no mobile home trailer sltali be located upon said demised premises.without lessee having first obtained a written permit tlierefor from [he lessor. 4. It is further imderstood and agreed by and between the parties hereto that no building or structure shall be placed, located, or erected upon demised premises without lessee having first obtained a written permit from Uie lessor therefor, the application for which permit shall be accompanied by a scale drawing showing the dimensions of the proposed building, the type of cons[ruction thereof, the proposed location thereof on demised premises, and such other information as may be required by the lessor. Any such building shall be completed and be suitable for habitation therein within one hundred eighty (180) working days after the issuance of such permit therefor. Any such improvements placed upon said demised premises shall remain the property of the lessee herein, and the lessee may remove the same upon the termination of this lease. Lessee further covenants to pay all property taxes assessed upon such improvements. 5. Lessee covenants and agrees to maintain said demised premises in a cican and wholesome condition, not to permit refuse or waste materials to collect thereon, and to mow said demised premises a minimum of ihree times each year, the first of which mowings shall be �vithin seven (7) days prior to D7ay 30th, the second of which shall be within seven (7) days prior to July 4th, and the third of which to be �vithin seven (7) days prior to the first 1llonday in September of each year. � o � 6. Lessee covenants and agrees not to keep or maintain any animals upon demised premises other than domestic household pets. ' 7. . It is understood and agreed by and between the parties hereto that all sanitary sewage systems must be installed under the supervision and with the approval of the Narrick County Sanitary Administrator, and shall be maintained in accordance with the rules and regulations of the Indiana State Board of Health and the local County Department of Public Health. 8. It is further understood and agreed by and behveen the parties that the lessee shall have access to the use of all park facIlities free from any charge therefor except the swimming beach facility and the overv night camping facility; provided, however, that the use thereof shall be at the sole risk of the lessee, free from any liabIlity for personal injury or property damage on the part of the lessor. 9. In the-event lessor believes that lessee has violated any of the terms and conditions of this lease or has defaulted in any of its provisions, lessor shall give notice in writing to lessee stating the nature of such vio- la[ion or default and the lessee shall have a period of fifteen (15) days from the date of the receipt of such notice in which to correct such violation or default and if not so conected within said period of time lessor shall have the right to terminate this lease. Upon termination of this lease as liereinabove provided, the lessee shall surrender full, complete peaceable possession of said demised premises within thirty (30) days from the termination thereof. 10. It is understood and agreed by anfl between the parties hereto that the lessee shall not sell, assign, transfer, or sublease,his interest in and to this leasehold agreement without Cast obtaining the written consent of the lessor thereto.
