Aff - Scott, Paul Ewing_4/15/1975 (3)7 ' �- � �• - •` AFFIDAVIT FOR TRANSFER OF REAL ESTATE UPON THE TAX DUPLICATE STATE OF INDIANA COUNTY OF GIBSON,SS: PAUL EWING SCOTT, being first duly sworn upon oath, deposes and says: •1: L'i31ie Benson Scot't', the mother of this affiant and the mother of Sylvester Benson Scott, departed this life, testate, a resident of Gibson County, Indiana, on May 9th.,. 1974, and this affiant is the duly appointed, qualified and acting Admin- istrator with Will annexed of the estate of said decedent, and. at the time of the death of Lillie Benson Scott she was the owner of the following described real estate, situate in Gibson County, State of Indiana, to-wit: The east half of the southwest quarter of Section 26, Township 2 south, Range 12 west, containing 82.19 acres, more or less; ALSO, A part of the we'st half of the southwest quarter of Section 26,�Township 2 south, Range 12 west, bounded as follows, to-wit: Beginning in the east line of said half quarter section 10.1/4 chains north of the southeast corner,.of the northwest�quarter of said south- west�quarter of said section, and •from thence running south 18 1/2 chains; thence west to the center line of a public highway running through said half quarter sec- tion; thence in a northerly direction along the center line of said highway to a point due west of the place of _ beginning; and thence east to the place of beginning, con- taining 2.97 acres, more or less, and containing in all 85.16 acres, more or less; A part of the east half of the northwest quarter and a part of the west half of the northeast quarter of Section 35, Township 2 south, Range 12 west, bounded as follows: Beginning at the northwest corner of said northeast quarter and running thence east 4 chains and 36 links; and from said point of beginning bear north, 3 degrees and 15 min- utes west, more or less, along an existing fence and its extension, a distance of 20.05 feet, to a 5/8 inch iron; thence continue on the same course, a distance of 233.90 feet to a 5/8 inch iron;thence bear north, 84 degrees and 02 minutes east, along an existing fence and its extension, a distance of 214.70 feet to a 5/8 inch iron at a corner post; thence bear south, 3 degrees and 44 minutes east, more or less, a distance of 262.SO feet to a 5/8 inch iron; thence continue on the same course., a distance of 31.20 feet to a 5/8 inch iron in the center of said Benson Road; thence bear north, 85 degrees and 20 minutes west, more or less, on the center line of said'road a distance of 218.70 feet, to a point of beginning, and containing 1.35 acres, BUT SUBJECT TO half the right-of-way of saidpublic road off of the south side of the above described tract; and • being.the real estate conveyed by Lillie B: Scott to Phillip E. Scott, April 3, 1973, see Deed Drawer 2, Card No. 6160, and containing, exclusive of said exception, 61.80 acres, more or less. • � All of the above described real estate and other real estate is subject to a Coal Lease and Agreement entered into under date of June 20, 1969, from Lillie B. Scott, a widow, Paul E. Scott and Mary Alice Scott, his wife, and Sylvester B. Scott and Elizabeth F. Scott, his wife, as Lessors, to Enos Coal Corporation, as Lessee, granting the right to mine and remove by any method except strip- mining all of the coal, fire clay, shale and solid miner- als in connection therewith, lying in and under the above described real estate (and other real estate), together with certain surface rights, for a term of forty (40) years. Miscellaneous Drawer 1, Card No..1176. There was as of the date of death a balance due on advance royalties under this contract $40.00 per acre.
