That the Husband shall pay to the Wife by cashier's check the sum of Eight Thousand Five Hundred Dollars within thirty days following the dissolution of the parties' marriage. At the time of the delivery of such cashier's checic the Wife shall execute aad deliver to the Husband a Release evidencing payment of such amount by the Husband. � 2. That the Husband shall also pay to the Wife the sum of Five Hundred Dollars per month for a period,of twenty-four months commencing on May 1, 1995, and payable on or about the first day of the following twenty-three months. That at such time as the final payment is made, the Wife shall execute and deliver to the Husband a Release evidencing payment of such amounts by the Husband. ' ' Such amount is deemed by the parties and therefore construed by the Court as a form of maintenance and as such the Husband agrees and stipulates that the same shall not be dischargeable in bankruptcy. Further comment that in the event that it is necessary that the Wife obtain counsel in order to enforce any provision or waiving relating to the collection of such money, then the Wife shall be entitled to recover her reasonable legal fees incurred and connection therewith. Finally, if the Husband dies prior to the time when said money is becomes due and payable, then the amount payable shall be paid from the Husband's estate at the earliest convenient date crhen distributions are to be made. 6. That the Husband shall be responsible for paying off in a timely manner any outstanding indebtedness in his individual name as well as the indebtedness at Gibson County Bank (excluding the mortgage indebtedness as referred to in the following paragraph) and Whirlpool Finance, as well as the Visa charges incurred and outstanding on or before the Provisional Order dated December 9, 1994, as well as the entire balance on the Mastercard account ahich is in his individual name. — 7. That the Wife shall be the owner of the parties' former marital residence located at RR1 Box 274, Princeton, Gibson County, Indiana, free and clear of any claim by the Husband and the Ausband shall execute and deliver a Quit Claim Deed transferring all of his right, title and interest thereia to the wife. ' .': secured by a certain mortgage thereon to Gibson County Bank as the same becomes due and payable and shall hold the Husband harmless from payment thereof. The Wife shall also be responsible for payment of all other expenses relating to her continued occupancy and ocrnership thereof, including, without limitation, real estate taxes, insurance, utilities, maintenance and upkeep. 8. That the Wife shall be the owner of all furniture, furnishings and appliances contained ia the aforesaid marital residence, together with the lawn mowers and yard equipment and all other items not personal to the Husband. The Wife shall surrender to the Husband any and all personal items and effects left in the mazital residence after his departure. These items include, without limitation, his grandfather's antique safe and his gray suit coat which is part of his uniform for Colonial Baking Company, his employer. The Husband shall also receive any photographs of himself, his parents, his grandparents and any personal items made by his mother as heirlooms. Additionally, however, the Husband shall continue to pay the mortgage oayments through the Aoril 1995 payment and the Wife's resoonsibility for paying the mortgage payment shall commence with the May 1995 payment. Further, the Husband agrees to pay the PSI meter reading (so long as the usage is customary and reasonable) as of May 1, 1995, or the closest date upon which such meter reading can be made. The Wife-shall be responsible for payment of the PSI expenses after the meter reading and the Wi€e shall also retain the deposit. 9.
