AFFIDAVIT OF DEATH AND HEIRSHZP
OF HENRIETTA TIEKEN. DECEASED
1. The above-named decedent died intestate on the 4th day of
January, 2002, while domiciled in Gibson County, Indiana, being
ninety-eight (98) years of age.
2. I was personally well acquainted with Henrietta Tieken,
the decedent, family and near relatives of the decedent, during the
decedent's lifetime, the affiant being a son of the decedent.
3. The decedent was a widow at the time of her death.
4. The decedent did not leave a will.
5. There was no administration on the estate of the decedent.
6. No petition for the appointment of a personal
representative of said decedent is pending in any Court in this
State and that forty-five (45) days have elapsed since the death of
the decedent.
7. No child or children were adopted by the decedent and che
decedent did not have any stepchildren.
8. The following named persons are the only surviving heirs
of the decedent: A1 J. Tieken, 206 Glenwood Dr., Vincennes, IN
47591; Bernard Tieken, RR #2 Box 131, Mt. Carmel, IL 62863; and
Virgil Tieken, 88642 S. Club Rd., Ferdinand, IN 47532
9. The value of the decedent's gross probate estate, less
liens and encumbrances, does not exceed the sum of the allowance
provided by I.C. 29-1-4-1, the costs and expenses of administration
and reasonable funeral expenses.
10. Among the decedent's probate assets is a parcel of real
estate which was owned by the deced2nt in her name only located in
Gibson County, Indiana, more particularly described as follows:

Part of the north half of the southwest quarter of
Section (31), Township (3) South, Range (10) West, in
Johnson Township, Gibson County, Indiana, and more
particularly described as follows:
Commencing at a mag-nail found flush over an iron marking
the northwest corner of said half quarter section; thence
South 89 degrees 04 minutes 43 seconds East along the
north line of said half quarter section seven hundred
twenty-seven and twenty-six hundredths (727.26) feet to
the centerline of the CSX railroad; thence South 06
degrees 30 minutes 00 seconds East along said centerline
two hundred seventy and no hundredths (270.00) teet to
the initial point of beginning of the following d2scribed
real estate; thence North 88 degrees 58 minutes 48
seconds East fifty-three and eleven hundredths (53.11)
feet to a 3/4" iron pipe found 1" below grade; thence
North 88 degrees 58 minutes 48 seconds East one hundred
eighty-one and eighty-nine hundredths (181.89) feet to a
1" iron pipe found flush marking the northwest corner of
a 0.299 acre parcel described in D.D.4, C-8140; thence
South 06 degrees 25 minutes 18 seconds East along the
west line of said 0.299 acre parcel sixty-six and eighty-
three hundredths (66.83) feet to a 5/8" iron pin set
flush (with cap LS #50137). on the line considered to be
the north boundary line of the property formerly owned by
E.K. Dutton; thence South 89 degrees 11 minutes 45
seconds West along said north line one hundred eighty-one
and eighty-nine hundredths (181.89) feet to a 5/8" iron
pin set flush (with cap LS #S0137); thence South 89
degrees 11 minutes 45 seconds West fifty-three and eleven
hundredths (53.11) feet to the centerline of said
railroad; thence North 06 degrees 30 minutes 00 seconds
West along said centerline sixty-five and ninety-five
hundredths (65.95) feet to the point of beginning.
Containing 0.356 acres, more or less.
Subject to the right-of-way of said railroad and the
right of the public to use a street, both along the west
portion of said o.356 acre tract.
Legal description from a survey dated February 26, 2001,
prepared by Fred J. Kuester, Registered Land Surv2yor,
Indiana Registration No. 50137.
Commonly known as 304 N. Main St. Haubstadt, IN 47639
SUBJECT TO all legal highways, rights-of-way,
restrictions, conditions, covenants, leases, easements
and limitations of record, and also to applicable zoning
laws, if any.
11. There are no creditors for the estate.
12. A1 J. Tieken, Bernard Tieken and Virgil Tieken, are
entitled to the real estate as the sole surviving heirs of
Henrietta Tieken.

� 13. The gross value of the estate of the deced2nt, Henrietta
Tieken, as determined for the purposes of Federal Estate taxes, was
less than the value required for the filing of a Federal Estate Tax
Return.. As a consequence thereof, the decedent's estate was not
subject to Federal Estate Tax.
14. The decedent's estate was not subject to Indiana
Inheri�ance Tax.
