NOW, THEREFORE, in consideration of the mutual covenants and agreemenu herein contained, it is hereby agreed by and beriveen the parties hereto that [he Co-Trustees shall hold and administer all such insurance policies or other property which from time to time may be added to the Trust (collectively hereinafter sometimes referred ro as the "Trust Estate") upon the following terms and conditions: 1. Property Trusteed. The property listed on Exhibit A, which is attached hereto and made a part hereof, are hereby transferred and delivered to the Co-Trustees, and the Co-Trustees hereby acknowledge receipt of such property. Sucu properry, together wiin any and ali other property �vhich may hereafter be transferred to the Co-Trustees by either the Grantors or anyone else, all of which property is hereinafter collectively referred to as the."Trust Estate," is hereby given to the said Co-Trustees to have and to hold; but nevertheless in Trust, for the following uses and purposes, and subject to terms, conditions, powers and agreements hereinafter set forth. 2. Additional Propertv. The Grantors and any other person shall have the right at any time to transfer, assign, convey or quitclaim any cash, securities, life insurance policies, or other property, real or personal, to the Co-Trustees and the Grantors or any other persons shall have the right to increase the Trust Estate by delivering property to the Co-Trustees, or by having the proceeds of life insurance policies made payable to the Co-Trustees, or by bequest or devise by Will. T'he duties and liabilities of the Co-Trustees shall under no circumstances be substantially increased except with the Co-Trustees' written consent. All of such additional property shall be administered and �� j V � • Trustees shall not be uoder any duty to see to the application of funds so paid, provided said Co-Trustees have exercised due care in the selection of the person to whom such funds aze paid. (h) No Limitations. The Co-Trustees shall have all rights, powers and authority granted to a Trustee under Indiana Code 30-4-3, Sections 3 and 4, as amended from time to rime, and Indiana Code 30-4-5, Section 1 through 17, as amended from rime to time. No specific powers given in this instrument to the Co-Trustees shall operate to limit or circumscribe the general powers, or ariy of them, given by this instrument or by law, it being my intention to confer on the Co-Trustees the broadest, fullest and most complete power and authority. The Co-Trustees may exercise all such power and authority in such manner, and to such extent, as to it, in its sole and absolute discretion, shall deem advisable and desirable.` Further, all power and authority herein granted to the Ce- Trustees, including all discretionary powers and authority, shall inure to and be fully exercisable by any fiduciary appointed by any court of competent jurisdiction. 6. Successor Trustee and Resienation or Removal of Trustee. The Grantors may, at any time during the Grantors' lifetimes, direct the resignation and removal of any Trustee, including . the right and power to remove any subsequendy appointed Trustee, whenever Grantors deem it advisable and without giving reason or cause for requesting such resignation and removal. 'I'he Trustee shall have the right.to resign at any time by giving tlurty (30) days advance written notice to the benefiFiaries of any Trust established under this Agreemen[. ARer the death, incapaciry, resignation or removal of one of tbe Co-Trustees, the Grantors' son, �_ James Roger Yeager, shall be the Co-Trustee along with the surviving Trustee. After the death, incapaciry, resignation or removal of the surviving Trustee, then Grantors' son, James Roger Yeager, s6all be the sole Trustee. In the event that with of Grantors' son is not able or not desirous of acting as successor Trustee or Co-Trustee, then Grantors' daughter, Cathy Rae Marcussen, shall be the successor Trustee. After the death of both of the Grantors, subject to the limitations hereinafter set forth, the beneficiaries of this Trust shall have the right and power to remove any Trustee, including the further right and power to remove a subsequently appointed Trustee, by thirty (30) days advance written notice to the Trustee being so removed. In the event of the death, resignation or removal of all of the above-named individuals as successor Trustee, then the Grantor shall have the right to appoint another successor Trustee.
