LEGAL DESCRIPTION
Part of the west half of the southwest quarter of Section (24) and a part of the east half of the southeast
quarter of Section (23), all in Township (2) South, Range (13) West Wabash Township, Gibson County,
Indiana and more particularly described as follows:
Beginning at a 5/8" rebar set flush (with a plastic cap inscribed "Greg Kissel RLS 20700076") [hereinafter
referred to as "rebar set"' marking the southeast corner of the west half of the southwest quarter of Section
24; thence North 88 degrees 18 minutes 22 seconds West along the south line of said half quarter section
thirteen hundred ten and forty-two hundredths (1310.42) feet to a 2" iron pipe found 8" below grade marking
the southwest corner of said half quarter section; thence North 00 degrees 24 minutes 36 seconds East along
the line as established by G.M. Emmerson per a legal survey dated October 14, 1901 and found in Survey
Book 3, Page 126 in the Gibson County Surveyor's Office fourteen hundred forty and no hundredths
(1440.00) feet to a rebar set in the center of Little Summers Ditch; thence North 57 degrees 18 minutes 43
seconds East along the center of said ditch six hundred forty and ninety-two hundredths (640.92) feet to a
rebar set; thence North 57 degrees 42 minutes 59 seconds East along the center of said ditch two hundred
ninety-nine and eighteen hundredths (299.18) feet; thence North 51 degrees 18 minutes 10 seconds East
along the center of said ditch one hundred eighty and twenty-seven hundredths (180.27) feet; thence North
42 degrees 45 minutes 29 seconds East along the center of said ditch two hundred two and five hundredths
(202.05) feet to a rebar set; thence North 43 degrees 11 minutes 32 seconds East along the center of said
ditch four hundred twenty-eight and seven hundredths (428.07) feet to the east line of the west half of the
southwest quarter of Section 24; thence South 01 degrees 25 minutes 33 seconds West along said east line
twenty-five hundred fifty-eight and fifty-seven hundredths (2558.57) feet to the point of beginning.

SURVEYOR'S REPORT
In accordance with Title 865, of the Indiana Administrative Code, this document is created to furnish the client with a
written surveyor's report that, in addition to other pertinent data, identifies the type of survey, explains the theory of
location applied in establishing or retracing the lines and corners of the surveyed parcel, and gives the registered land
surveyor's professional opinion of the cause and the amount of uncertainty in those lines and corners because of the
following: (A)Availability and condition of reference monuments. (B)Occupation or possession lines. (C)Clarity or
ambiguity of the record description used and of adjoiners' descriptions and the relationship of the lines of the subject
tract with adjoiners' lines. (D)The relative positional accuracy of the measurements.
TYPE OF SURVEY: Retracement
PURPOSE: To mark the corners and prepare a plat of a parcel of land as described as Deed Bk. 149, Pg. 356.
AVAILABILITY & CONDITION OF REFERENCE MONUMENTS:
At the southwest corner of the west half of the southwest quarter of Section 24, a 2"outside diameter iron pipe
is found 8"below grade. In the section corner reference book found in the county surveyor's office, an "iron over
stone" is shown to mark the corner. References to headwalls are given; however, during the fieldwork said headwalls
are gone. A survey by Fred Kuester, LS dated 2000 (Doc. #2001-205) shows an iron pipe marking said corner and is
said to be verified by references per the county surveyor's reference book. Furthermore, a survey completed by this
surveyor dated 11/03/2011 (Doc. #2011-5898)calls out the same iron pipe to mark this corner. Said 2" outside
diameter pipe is used and accepted on this survey.
At the southeast corner of the southwest quarter of said section, an iron pin w/a 1 '/," round head is found 11"
below grade. An iron is documented in the county surveyor's section corner book. A survey completed by Harry C.
Morrison in the early 1900s and found in Survey Bk. 3, Pg. 288, on file in the county surveyor's office, shows a Ford
axle marking this corner. Also, a witness iron is noted to be north 20' from said Ford axle on said Morrison survey.
On this survey, a witness 1 3/4"x 1/2" flat iron is found 7" below grade and measured precisely 20' north of the found
iron pin w/round head. A route survey completed in 2008 by Coralina Candler, LS of Schneider Corp. shows a I ''A"
round iron pin found per county surveyor's records. Said 1 %" round head iron is used and accepted on this survey.
At the northeast corner of the southwest quarter of said section, a 2 '/z" casting is found 6" below grade, and 7'
east of the centerline of a county road and is also in alignment with a tree line to the west. In the said section corner
reference book, an iron is documented to mark the corner. On said Morrison survey(Survey Bk. 3, Pg. 288)an iron is
shown to mark this corner, with a reference to a witness iron 50' west. On this survey, an iron w/a 2" diameter round
head(possible wagon hub) is found 8" below grade and measured precisely 50' west of the said 2 ''/z"casting. A
survey by Fred Kuester, LS dated 10/23/2000(Doc. #2001-206) indicates a 2 /"casting found 6" below grade and
being 7' east of the centerline. On the said 2008 route survey, a 2 '/:" diameter pipe casing w/square top is noted to
mark the corner. Said 2 1/2"casting is used and accepted on this survey.
At the northeast corner of the southeast quarter of the northwest quarter of said section, a 1 '/" iron pin is
found 12"below grade in concrete. In the said section corner reference book, a 11" iron monument is found 12"
below grade in concrete by Fred Kuester, LS in 2000 (Doc. #2001-206). See said 2000 Kuester survey for further
details regarding the 1 %" iron pin.
At the northwest corner of the southeast quarter of the northwest quarter of said section, a 2" casting
(triangularly shaped) is found 7" below grade. Documentation found in the section corner reference book states a 2"
casting found 2" below grade and I' north of the centerline by Fred Kuester, LS in 2000. A survey completed by G.M.
Emmerson in 1889 (Survey Bk. 3, Pg. 30) uses the said casting to mark this corner. For more details regarding this
corner marker, refer to said 2000 Kuester survey(Doc. #2001-206).
At the northeast corner of the west half of the southwest quarter of said section, a 1 ''A" iron pin w/a 2"
diameter top is found 5" below grade. The said section corner reference book states this iron pin to mark the corner
per said 2000 Kuester survey(Doc. #2001-206). A casting is noted in a survey by G.M. Emmerson dated 1889
(Survey Bk. 3, Pg. 30). Furthermore, the distance to the northeast corner of the southwest quarter of said section
nearly coincides with a dimension per an A. E. Morrison survey dated 1926 (Survey Bk. 3, Pg. 253) as shown on the
plat. Said 1 '/" iron pin is used and accepted on this survey.
At the southwest corner of the southeast quarter of the southeast quarter of Section 23, a 2 '/" iron pipe is
found 1" below grade. Said iron pipe is used by this surveyor on a previous survey dated 2011 (Doc. #2011-5898).
See said 2011 survey for more information on the iron pipe.
At the northwest corner of the southeast quarter of Section 23, an iron bar is found as shown on the plat. In the
section corner reference book found in the county surveyor's office, a buggy axle is shown to mark this corner. Said
iron bar is used in said 2000 Kuester survey(Doc. #2001-205), and by this surveyor(Doc. #2011-5898). See said
2011 survey for further information regarding the iron bar.
At the northeast corner of the northwest quarter of the southeast quarter of Section 23, a 5"x4" stone is found
as shown on the plat. The section corner reference book did not show any information regarding this corner. The
origin of said stone is believed to be per a survey by G.M. Emmerson dated 1887(Survey Bk. 3, Pg. 11). Said stone is
also used in a survey by Harry C. Morrison dated 1941 (Survey Bk. 3, Pg. 365). Furthermore, said stone is used in
said 2011 survey by this surveyor(Doc. #2011-5898).

The northwest corner of the southwest quarter of Section 24 is documented to be a stone per the current corner
reference book on file in the county surveyor's office. This corner is shown to be marked by a rock in 1860 per a
survey-by Stillwell on file in Survey Bk. 2, Pg. 123 in the county surveyor's office. Also, this corner is shown to be
marked by a stone in 1926 per a survey by Morrison on file in Survey Bk. 3, Pg. 253 in the county surveyor's office.
Furthermore, this said stone location appears to be used by Morrison in 1941 per Survey Bk. 3, Pg. 365 on file in the
county surveyor's office. On this survey no stone could be found. Much of the ground in the vicinity has been
disturbed due to farming activities. However, a 3/d' iron pin is found as shown on the plat beside a disturbed stone
piece lying on the ground. The location of the said found iron pin varies only slightly(+/- 2') from dimensions of old
surveys tied to the old stone location. Therefore, the found %" iron pin is believed to be the best available evidence as
to the location of the stone in the above mentioned 1860, 1926, and 1941 surveys. It is noted that this location varies
60.06' east of the location per a survey dated 1901 which will be discussed following explanation.
OCCUPATION OR POSSESSION LINES
The south possession of the surveyed parcel is to the county road.
The ditch marks the apparent line of possession on the west and north lines of the surveyed parcel.
Along the east line, the possession along the north portion is not apparent, and on the south portion the line of
possession appears to be to the levee.
CLARITY OR AMBIGUITY OF THE RECORD DESCRIPTION
The record description of the subject tract is found in Doc. #2002-9999 and is the same description as found in
D.B. 149, Pg. 356. Said description is metes and bounds and being and lying south of the center line of the Little
Summers Ditch and lateral ditch. There appear to be no gaps and/or overlaps in record descriptions on this survey.
MISCELLANOUS MONUMENTATION
Near the northwest corner of the southwest quarter of the northwest quarter of Section 24, a stone is found 8"
below grade with an iron pin leaning over the stone. Said stone position lines up with a field divide to the north. The
section corner reference book calls out a 6"x8" stone, 7" below grade and found by Fred Kuester, LS in 2000 and
shown on said record survey(Doc. #2001-206). A stone is called for in a survey by A.H. Polk dated 1880(Survey Bk.
2, Pg. 318). However, a legal survey by G.M. Emmerson dated 1902 (Survey Bk. 3, Pg. 126) shows a casting marking
the said corner with a reference to a stone being 62' east. Also, on this survey a 1" iron pipe is found 56.5' east of the
stone. The location of this corner is not verified on this survey.
THEORY OF LOCATION/METHOD OF CORNER ESTABLISHMENT
According to Survey Bk. 3, Pg. 126 on file in the county surveyor's office, a legal survey was conducted by
G.M. Emmerson, surveyor of Gibson County, in this region. This said Emmerson survey is dated October 1901 and
also reference to a survey dated 1893. Said Emmerson survey states "it was determined to locate a part of said ditch
upon the east line of Sections 23 & 26, and said lines having long been in dispute, it became necessary to determine
which was the correct line. The surveyor suggests that with the consent of the land owners of the west half of Section
24 and all of the land owners of Section 26&23 he would be able to fix the lines so as to end the dispute. Stakes were
set showing the changes that would be made, and all parties agreeing thereto the ditch was so located. This survey
was made to ogee said stakes as set in 1893. All parties to the matter were notified in writing for more than 10 days
prior to the 14' day of October 1902". According to said Emmerson survey, a casting was set at the northwest corner
of the southwest quarter of Section 24, 91 links west of the stone. This survey indicates uncertainties for the west line
of Section 24 and uncertainties of the west line of the subject tract. However, due to the documentation of this 1901
legal survey and consent of the parties in 1901, the line established by Emmerson is used to establish the west line of
the subject tract on this survey. Said Emmerson line is calculated 91 links west of the found '/." iron pin accepted on
this survey to mark the northwest corner of the southwest quarter of Section 24. The resulting Emmerson line more
nearly coincides with the current possession line than the section line.
The northwest corner of the subject tract is established on said Emmerson line and its intersection with Little
Summers Ditch.
The southeast corner of the subject tract is established at the midpoint of the south line of the southwest
quarter of said section.
The deflection points set on the north line of the surveyed parcel are established in the center of the ditch per
said record description.
The northeast corner of the subject tract is established on the east line of the half quarter section and its
intersection with Little Summers Ditch.
RELATIVE POSITIONAL ACCURACY OF THE MEASUREMENTS
Rural Survey: 0.26 feet plus 200 parts per million.
