Affidavit - Bender, Dorothy_12/31/2014 FILE :it D3EC 31 2014 GIBSON COUNT' y AUDITOR AFFIDAVIT FOR TRANSFER OF REAL ESTATE ON AUDITOR'S RECORDS MARK J. BENDER, in his capacity as Personal Representative of the Estate of Dorothy M. Bender, Deceased (hereafter "Affiant"), being duly sworn upon oath, states: 1. Affiant is a competent adult. 2. Affiant has personal knowledge of the matters stated herein. 3. Dorothy M. Bender died testate on January 18, 2014, while a resident of Gibson County, Indiana; and the Last Will and Testament of Dorothy M. Bender dated September 20, 1988, was duly submitted for probate on February 26, 2014; and that Affiant was duly appointed by the Gibson Circuit Court as Personal Representative of the supervised Estate of Dorothy M. Bender on February 26, 2014, under Cause Number 26C01- 1402-ES-00020. 4. At the time of Decedent's death, Dorothy M. Bender was the owner of the following described real estate in Gibson County, State of Indiana, to-wit: Tract I — Tax Co de No. 26-17-25-200-000.107-021 ✓ An undivided one-half ('/) interest in and to the following described real estate: A Part of the Northwest Quarter of Section 25, Township 3 South, Range 12 West, bounded as follows, to-wit: Beginning in the South line of said quarter section at a point 1,669.4 feet East from the Southwest corner of said quarter section, and run thence North 422 feet to the center of a natural watercourse; thence down said watercourse in a Northwesterly direction following the meanderings thereof to its confluence with the Black River Drainage Ditch; thence up the center line of said Black River Drainage Ditch in a Northeasterly direction with the meanderings thereof to the North line of said quarter section; thence East to the Northeast corner of said quarter section; thence South on the East line of said quarter section to the Southeast corner thereof; thence West to the place of beginning, containing 85.86 acres, more or less. ALSO, part of the northwest quarter of the northeast quarter of Section 25, Township 3 South, Range 12 West, described as follows: The place of beginning may be found at the northeast corner of said quarter quarter thence south along the east line thereof, two hundred and no hundredths (200.00) feet; thence west and parallel to the north line of said quarter quarter one hundred seventy-seven and ninety hundredths (177.90) feet, more or less to the centerline of Highway #65; thence north eight (8) degrees west and along the centerline of said road, two hundred one and ninety- seven hundredths (291.97) feet to the north line of said quarter quarter; thence east along the north line thereof two hundred six (206) feet, more or less, to the place of beginning and containing 0.8792 acres. Subject to the east right-of-way of Highway #65. ALSO, part of the west half of the northeast quarter of Section twenty-five (25), Township three (3) south, Range twelve (12) west, Montgomery Township, Gibson County, Indiana and more particularly described as follows: The place of beginning may be found at the southwest corner of said half, quarter section and run thence north along the west line thereof, twenty-six hundred forty (2640) feet, more or less, to the northwest corner thereof; thence east along the north line thereof eleven hundred fourteen (1114) feet, more or less to the center line of Highway #65, and at a point two hundred six (206) feet, more or less, west of the northeast corner of said half quarter section; thence south eight (8) degrees east along the centerline of said highway two hundred one and ninety-seven hundredths (201.97) feet; thence east and parallel to the north line thereof, one hundred seventy-seven and ninety hundredths (177.90) feet more or less to the east line of said half, quarter section and at a point two hundred and no hundredths (200.00) feet south of the northeast corner thereof; thence south along the east line, twenty-four hundred and forty (2440) more or less feet to the southeast corner thereof; thence west and along the south line of said half, quarter section thirteen hundred and twenty (1320) feet, more or less, to the place of beginning and containing 78.3708 acres. ALSO, a part of the south half of the southeast quarter of Section twenty-four (24), Township three (3) south, Range twelve (12) west, and bounded as follows, to-wit: Commencing at the southeast corner of said section twenty-four (24), thence north two hundred and six (206) feet to the northwest corner of section thirty (30), township three (3) south, range eleven (11) west, thence west ten (10) rods; thence south two hundred and six (206) feet to the south line of said quarter section; thence east ten (10) rods to the place of beginning, containing 0.78 acres, more or less. Tract Ill — Tax Code No. 26-18-30-100-000.056-025 An undivided one-half (1/2) interest in and to the following described real estate: • The northwest quarter of Section thirty (30), Township three (3) south, Range eleven (11) west in Union Township, Gibson County, Indiana, containing 129.47 acres, more or less. Tract IV — Tax Code No. 26-17-25-200-000.103-021 An undivided one-half (1) interest in and to the following described real estate: The northeast quarter of the northeast quarter of Section twenty- five (25), Township three (3) south, Range twelve (12) west, in Montgomery Township, Gibson County, Indiana containing 40 acres, more or less. Tract V — Tax Code No. 26-17-27-300-000.098-021 The South part of the southwest quarter of Section 27, Township 3 south, Range 12 west, described as follows: Commencing at the southwest corner or the said southwest quarter, thence east 80 rods more or less to the southwest corner of a tract of land deeded to Andrew J. and Lythena Calvert, thence north 111 rods, thence west 80 rods more or less to the west line of said section, thence south to the place of beginning, containing 55 1/2 acres, more or less. Tract VI — Tax Code No. 26-17-33-200-000.099-021 Sixty-five and ninety-three hundredths (65.93) acres in the form of a parallelogram off of the east side of the northeast quarter of Section 33, Township 3 south, Range 12 west.
