Thelma White Froyd. a resident of Gibson County, State of Indiana. do hereby make. publish and declare this to be my Last Will and Testament hereby revoking any and all former Wills and Codicils heretofore made by me. ITEM I I direct that all expenses of my last illness and my funeral and burial expenses be paid from my estate as soon after my death as is reasonably practicable. ITEM II At the date of execution of this Will I am not married. My children are Jeffrey Edwin Froyd and Stephen Cooper Froyd. ITEM III I give, devise and bequeath all the rest and residue of my property and estate, both real and personal. of whatsoever kind and wheresoever situate, of which I may die seized or possessed or of which I may be entitled to dispose of at the time of my death as follows: I. To my grandson. Nathan Froyd. if he shall survive me for a period of thirty (30) days. seven percent (7%) of the residue of my estate: 2. To my granddaughter.Cara Froyd. i fshe shall survive me for a period of thirty (30) days. seven percent (7%) of the residue of my estate; and 3. To my granddaughter, Man Froyd, if she shall survive me for a period of thirty(30) days. seven percent (7%) of the residue of my estate. In the event any of the above-named beneficiaries shall fail to survive me for a period of thirty (30) days. the gift to said beneficiaries shall lapse. Thelma White Froyd . • ? 37 • 4. After payment of the above bequest, the rest and residue of my property and estate, including any of the devises herein above in paragraphs I, 2. and 3. which shall lapse, shall be paid as follows: A. One-half( 1/2) to Jeffrey Edwin Froyd if he shall survive me for a period thirty(30) days and in the event he shall fail to survive me for a period of thirty(30)days,his share of my estate is given,devised and bequeathed to his wi ft,Joy Froyd,on condition that she survive me for a period of thirty (30) days and if she shall fail to survive me for a period of thiny(30) days. then the share that would have passed to Jeffrey Edwin Froyd or his spouse,Joy Froyd, I then give to their issue in equal shares per stirpes. B. One-half( 1/2) to Stephen Cooper Froyd if he shall survive me for a period thirty(30) days and in the event he shall fail to survive me for a period of thirty(30)days. his share of my estate is given,devised and bequeathed to his wife, Susan J. Froyd, on condition that she survive me for a period of thirty (30) days and if she shall fail to survive me for a period of thiny(30) days, then the share that would have passed to Jeffrey Edwin Froyd or his spouse, Susan J. Froyd, I then give to their issue in equal shares per stirpes. ITEM IV I hereby nominate and appoint my son, Jeffrey Edwin Froyd, as Personal Representative of this. my Last Will and Testament, and if for any reason he shall fail to qualify or cease to serve as such Personal Representative then I nominate and appoint my son,Stephen Cooper Froyd,as Personal Representative of this, my Last Will and Testament. It is my intention that the requirement of any bond to be provided by my Personal Representative be dispensed with or fixed at a minimum amount, and in the event any such bond is required, such bond shall be only for the benefit of creditors and taxing authorities. ITEM V I hereby authorize the Personal Representative of my estate to do all things which he may determine desirable or expedient for the advantageous control of my estate without Court authorization,direction.confirmation orapproval,and in the exerciseofsuch authority,such Personal Representative shall have the right and power to sell.conveyor exchange,without Court intervention. „ e Thelma White Froyd F 238 authority or approval,real or personal property of my estate,and any sale or exchange of property may be accomplished publicly or privately, with or without notice,and without formal appraisal,provided that valuation of any asset shall have been determined by standard appraisal methods in use in the community at the time, for cash, or on such terms and conditions as such Personal Representative considers proper, without being required to report such action to Court or to obtain Court confirmation thereof, and no person purchasing property shall be required to see to the proper application of the proceeds of such sale by such Personal Representative.
