• PETITION TO APPOINT SUCCESSOR TRUSTEE
Comes now Wanda Ann Plummer, by counsel, L. Matthew Nixon, and Petitions
• the Court to appoint a Successor Trustee of the Percy L. Overton Testamentary Trust and
in support thereof states as follows:
1. That Percy L. Overton died on November 28, 1973 and his Will was
submitted to probate in the Gibson Circuit Court on December 12, 1973.
2. That Percy L. Overton was survived by three (3) children, David L. Overton,
Wanda Ann Plummer and Gordon E. Overton.

3. That pursuant to Item Five (5) of the Decedent's will, he left 14 acres of farm
ground and 60.96 acres of farm ground to David L. Overton, as Trustee for
the benefit of Wanda Ann Plummer and her descendants under certain terms
and conditions as provided for in said Item Five (5).
4. That David L. Overton, Trustee is now deceased. Wanda Ann Overton prays
for an Order of the Court appointing herself as Successor Trustee and
appointing alternate Trustees, David Keith Plummer and Nicholas Wayne
Plummer(her only two sons) should Wanda Ann Plummer fail or cease to
serve as Trustee.
5. David Keith Plummer and Nicholas Wayne Plummer are the Petitioner,
Wanda Ann Plummer's only two children and successor beneficiaries '
pursuant to the Percy L. Overton Testamentary Trust pursuant to Item Five (55
of The.Last Will and Testament, neither of which have children. They have
both joined in this Petition pursuant to their signatures below,
6. There are no other interested parties. •

WHEREFORE, the Petitioner prays for an Order of the Court appointing her
• Successor Trustee, and David Keith Plummer and Nicholas Wayne Plummer, as
Co-Successor Trustees and for all other just and proper relief in the premises.

ORDER APPOINTING A SUCCESSOR TRUSTEES
Comes now Wanda Ann Plummer, by counsel, L. Matthew Nixon, and having
filed her Petition to Appoint Successor Trustee.
And now the Court, having examined the Petition and being duly advised in the
premises, now finds as follows:
1. That Wanda Ann Plummer be appointed successor trustee of the Percy L.
Overton Testamentary Trust.
2. That should Wanda Ann Plummer fail or cease to serve a trustee, that David
Keith Plummer and Nicholas Wayne Plummer be appointed Co-Successor
Trustees of the said Trust.
