SURVEYOR'S REPORT In accordance with Indiana Survey Standards as defined in the Indiana Administrative Code (865 IAG 1-12 "rule 12"), the following observations and opinions are submitted regarding the various uncertainties in the locations of the lines and corners established this survey as a result of: Availability, Condition and Integrity of Reference Monuments Record Documents Lines of Occupation, and i - Relative Positional Accuracy of Measurements There may be unwritten rights associated with these uncertainties. Ii The purpose of this survey is to monument and describe the survey tracts as shown on the plat of survey to assist in the following: establish the tines and corners for a 0.06 acre tract to be conveyed and attached to the Parcel to the east (Parcel ID 26-19-31-303-000.151-009); develop an updated description for the Haub Steakhouse restaurant parcel (Parcel ID 26-19-31-303-000.152-009). The survey was requested by Mr. Larry Haley. Real-time GPS and conventional survey equipment were used to locate the found monuments at the PLS corners and survey corners as shown on the survey plat. The RPA of this survey is within the specifications set forth by IAC 865 for an "Urban" survey (0.07 feet plus 50 parts per million). Instrument PG 3 OF 4 201601J1J0J1705 Record Documents The Subject tract is described by metes and bounds per Document 1993-2037 and Document 1994-0490. The record descriptions found in Document 1993-2037 for Tracts 4a, 4b, 4c, and 4d describe the subject tract. The commencing corner for Tracts 4b, 4c, and 4d is the intersection of the centerline of the railroad with the north line of the South Half of the Southwest Quarter of said Section 31 . The commencing corner for Tract 4a is the northwest corner of a tract of land described as beginning at a post standing in the line dividing the north and the south halves of the South Half of the Southwest Quarter of said Section 31 , said tracts east line being 334.9 feet east of the eastern boundary line of the railroad, said tracts north line being 523.2 north of said line dividing the north and the south halves of the South Half of said Southwest Quarter. Thence from said commencing northwest corner the dimensions of Tract 4a are 180 feet (north-south parallel to the centerline of the railroad) by 247.65 feet east-west_ The description for the tract described in Document 1994-0490 commences at the northwest corner of Lot Number 352 of East Park Addition to the Town of Haubstadt and is based on a survey by Lee Hoffman dated March 24th, 1993. The description does not call out any monuments but said Hoffman survey indicates various monuments found or set at the described corners None of these monuments were found this survey. A survey by Fred Kuester recorded in Document 2012-0598 is referenced this survey. A survey be Lee Hoffman provided by the client dated March 24th, 1993 is referenced this survey. A survey recorded in Survey Book 3 Page 206 is referenced this survey. The Plat of East Park Addition to the Town of Haubstadt recorded in Plat Book 1 Page 180 is referenced this survey. The record descriptions for the adjoining Preske tract described in Document 2002-0753 overlaps the southeast portion of Survey Tract 2 described in Document 1994-0490. It is believed by this surveyor that the Preske description is in error Reference Monuments and Theory of Location In the field research for this survey, sufficient evidence was found, as shown on the survey plat, which provided data to verify or reestablish the record title lines of the subject tract. Unless noted otherwise on the plat of survey, all found and set monuments are flush with the ground, in good material condition and firmly set in the ground. This report provides information on the found monuments that were used to support this survey by identifying each monument by its survey point letter_ Variances were found with the measured distance between found monuments as compared to their record calls and are noted on the accompanying plat. Points A and B - found monuments per Gibson CountySurveyor Corner Notes. Y Points C - calculated corner at the midpoint of the line from Point A to Point B. Point D - monument set this survey at the intersection of the north line of Haub Street and the west line of First Ave_ The corner location was developed from the establishment of street centerlines from back of sidewalk locates and the right of way widths given on Plat Book 1 Page 180. The right of way of Haub Street is not platted west of this intersection per Plat Book 1 Page 180 Said Hoffman survey calls for a railroad spike at this corner but was not found this survey. Point E - monument set along the west line of First Ave at the record distance from Point H. Said Hoffman survey calls for a set 5/8 inch iron pin at this corner but was not found this survey. A 5/8 inch iron pin was found 13.53 feet west and 2 05 feet south of the set monument but was not held this survey. Point F - monument set along a line parallel to a Line from Point H to J at the record distance from Point E. Point G - monument set along line HJ at the record distance of 88.25 feet from H. Point H - found 3/4 inch iron pin 4 inches below grade, origin unknown, held as the southeast corner of Tract 1 described in Document 1993--2037. The measured distance from Point H to the north line of the South Half of the Southwest Quarter of said Section 31 (as established this survey from the F. Kuester survey and ties to Points R, S, and T) is within 0.42 feet of the record call. The measured distance from Point H along a line through Point J to the centerline of the existing railroad is 374.23 feet; the platted distance is 375.4 feet per Plat Book 1 Page 180. Point J - found 1 inch iron pipe held as the southwest corner of the north adjoining tract described as Tract 2 in Document 1989-3839; believed to be a monument set per the referenced survey in Survey Book 3 Page 206. The distance from Point J to Point H is within 0.73 feet of the record call Point K - monument set along line HJ extended westerly to the intersection of the west line of the railroad. A 5/8 inch iron pin was found 0.39 feet west and 4.74 feet north of the set monument but was not held this survey. Point L - found angle iron in concrete along the east line of the railroad at a measured distance of 0.72 feet longer than the record distance from Point K. Point M - calculated corner for the northeast corner of Tract 1 of Document 1993-2037 at the record distance from Point H and the centerline of the railroad. Said corner is within 0.42 feet of the record call to the north line of the South Half of the Southwest Quarter of said Section 31. Points N and P - set monuments at a location picked by the client. Points R, S, and T - found monuments as referenced in said F. Kuester survey recorded in Document 2012-0598. Ties were made to these monuments to reestablish the north line of the South Half of the Southwest Quarter of said Section 31 . Point V - calculated corner for the northwest corner of the north adjoining Robert Will tract described in Document 1988-2051 . Said calculated corner is 13.60 feet south of said north line of the South Half of the Southwest Quarter of said Section 31 . The record call is 10.00 feet. Per this survey there is 3.60 feet of uncertainty in the north-south location of all the established corners along the east line of the railroad contiguous with the west line of Survey Tract 2. Per this survey there is 0.42 feet of uncertainty in the north-south location of all the established corners along the west line of First Ave. Per this survey there is as much as 1 .56 feet of uncertainty in the east-west direction due to measured distances between found monuments compared to the record calls between said monuments. This surveyor believes that there are various title issues with the tracts bounded by Gibson Street, First Avenue, Haub Street, and the east line of the railroad. These issues are a result of different commencing corners, a lack of original corner monumentation in this area, and prior surveys establishing the north line of the South Half of the Southwest Quarter of said Section 31 at a location different than recent surveys. This survey ties the subject tract to known PLS corners and describes all that part of the subject tract that contains the Haub Steakhouse facility as one composite description with one commencing corner. Existing lines of occupation or possession if any exist are noted on the survey plat. Reservations Except as specifically stated or shown on the accompanying Survey Plat, this survey does not purport to reflect any of the following which may be applicable to the subject tract: restrictive covenants; zoning or other land use regulations; building setback lines; easements.
