THIS INDENTURE WITNESSETH, that DAZA DEVELOPMENT CORPORATION,
an Indiana corporation ("GRANTOR") . of R. R. 3, Petersburg, Pike
County, Indiana 47567, CONVEYS and SPECIALLY WARRANTS to MARGARET
SETJE-EILERS, ("GRANTEE") , of Vanderhurgh County, in the State of
Indiana, for the sum of ONE DOLLAR ($1.00) and other valuable
consideration, the receipt whereof is hereby acknowledged, the
following described real estate in Gibson County, State of
Indiana, to-wit:
Condominium Unit Number 2, in Building Number "B" in
Garden Park Condominiums, an Expandable Condominium,
(also an undivided 26% interest in the common areas and
facilities, both general and limited, appertaining to
said Condominium Unit) , as recorded on August 5, 1987,
in Condominium Drawer 1, Card 1, an entitled Declaration
for Garden Park Condominiums, an Expandable Condominium,
and in Ownership Plat File No. 1, of Condominium Floor
Plans in the office of the Recorder of Gibson County,
Indiana, commonl} known and designated as No. 2,
Swallowfield Drive, Princeton, Indiana.
Said undivided interest in the Common Area, and Limited Areas is
subject to adjustment and alteration in the event of expansion of
Garden Park Condominiums, an Expandable Condominium, as provided
in the Declaration.
The Condominium Unit is intended for residential purposes
exclusively, and shall be limited to such use. The use and enjoy-
ment of the Condominium Unit and the Common Areas and Limited
Areas are subject to the terms, provisions, conditions, covenants,
restrictions, limitations, and requirements contained in the
Declaration and the Code of By-Laws of Garden Park Homeowners'
Association, Inc. , attached to and incorporated in the Declara-
tion.
THIS CONVEYANCE IS SUBJECT TO:
(a) the lien of real estate taxes and assessments for
the year 1988, due and payable in November, 1989, and
all taxes and assessments subsequent thereto;
(b) The terms, provisions, conditions, covenants,
restrictions, limitations, requirements and liens of or
under:
(i) The Declaration of Garden Park Con-
dominiums, an Expandable Condominium;
(ii) the Code of By-Laws of Garden Park Homeowners'
Association, Inc. ; and
(iii) the Horizontal Property Law of the State of
Indiana.
(c) legal highways and rights-of-way, and all ease-
ments, covenants, conditions, reservations, restric-
tions, limitations and other matters of record.
The warranties of Grantor hereunder are limited to its own
acts and deeds and not otherwise.
Grantor certifies that there is no Indiana gross income tax
due or payable in connection with this conveyance.
The undersigned persons executing this deed on behalf of
Grantor represent and certify that they are duly elected officers
of Grantor and have been fully empowered, by proper resolution of
the Board of Directors of Grantor, to execute and deliver this
deed; that Grantor has full corporate capar;ity to convey the real
estate described herein; and that all necessary corporate action
for the making of such conveyance has been taken and done.
