WHEREAS, the road way is open is not needed. Vacation of the road way would not hinder orderly development of the neighborhood in which it is located or to which it is contiguous, would not make access to any lands different or inconvenient, would not hinder the use of a public's access to a church, school or other public building or place, and would not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous, and WHEREAS, in accordance with IC 36-7-3-16, vacation of the public road way will not deprive a public utility of the use of all or part of the vacated road, and vacation of the road will have no effect on any public utility that has utilities in the vacated road, and there are no sewer utilities in the road, and WHEREAS, a public hearing has been held on the Petition within thirty (30) days of receipt, and WHEREAS, notice of the public hearing on the Petition was given by certified mail to all owners of land that abuts the road way or by manner prescribed in IC 5-3-1. WHEREFORE, BE IT ORDAINED by the Oakland City Common Council, Oakland City, Gibson County, Indiana as follows: SECTION 1 : South Mulberry Street from intersection of West Division Street to South Main Street a distance of 147.6 feet south and 15 feet wide be and hereby J vacated. SURVEYOR'S REPORT In accordance with Indiana Survey Standards as defined in the Indiana Administrative Code (865 IAC 1-12 "rule 12"), the following observations and opinions are submitted regarding the various uncertainties in the locations of the lines and corners established this survey as a result of: Availability, Condition and Integrity of Reference Monuments Record Documents Lines of Occupation, and Relative Positional Accuracy of Measurements There may be unwritten rights associated with these uncertainties. The purpose of this Retracement Survey is to identify the record title lines of a tract being part of Lot 1 of Block 2 of Trusler's Addition to the Southern Enlargement of Oakland City, Gibson County, Indiana currently owned by Glenn and Sonja Highfill as described In Document 2019-74. Real-time GPS equipment was used to locate the found monuments at the lot corners as shown on the survey plat. The Relative Positional Accuracy, as defined by IAC 865, is a value expressed in feet that represents uncertainty due to random errors in measurement of any point on a survey relative to any other point on the same survey, at a 95 percent confidence level. The RPA of this survey is within the specifications set forth by IAC 865 for an "Urban" survey (0,07 feet plus 50 parts per million). Record Documents The subject tract description recorded in Document 2019-74 is described in metes and bounds with no calls for monuments at any corners. Trusler's Addition to the Southern Enlargement of the Town of Oakland (now Oakland City) is recorded in Plat Book 1 Page 84 and is referenced this survey. Plan of the Southern Enlargement (and its connections) to Oakland (now Oakland City) is recorded in Plat Book 1 Page 81 and is referenced this survey. Reference Monuments and Theory of Location In the field research for this survey, sufficient evidence was found, as shown on the survey plat, which provided data to verify or reestablish the record title lines of the subject tract.
