' Defendants. ) JUDGMENT NUNC PRO TUNC The Court, having examined the record of this case and being duly advised now finds: Plaintiff State of Indiana (the "State') filed its Complaint for Appropriation of Real Estate ("Complaint.') on July 15,2025. • 2. All Defendants were served with notice as required by statute. 3. The Complaint complies with Indiana eminent domain law, and this Conti has jurisdiction over the subject matter of this case and all patties. 4. The State seeks to acquire fee simple title to real estate owned by Defendants, as described in the Complaint. 5. No objections were filed to the Complaint under Ind. Code § 32-24-1-8, and the timefrarne to do so pursuant to Ind. Code § 32-24-1-8(b)(3) has lapsed. 6. The State is entitled by law to acquire the interests in the Real Estate Interest described in the Complaint. 7. On or about October 29, 2025, the Court through its Order of Appropriation and F ILEApointment of Appraisers, ordered the appropriation of the zeal estate described in the Complaint Mar 24 2026 Yfr,;,fitd a ,file" 'rel GIBSON COUNTY AUDITOR CB 26-13-24-100-000.761-006 I • and appointed three disinterested parties to assess the compensation due to Defendants. 8. On or about November 10, 2025, the Court-appointed appraisers filed their Report and found that Defendants Gene A. Pflug and Gloria J. Pflug, husband and wife, as tenants by the entirety were entitled to receive total just compensation of$1,000.00 as a result of the appropriation. 1 9. On or about January 2, 2026, the Clerk of the Court sent notice of the Report of . Appraisers to all parties and attorneys of record by United States certified maiL .10. If exceptions to the Report of Appraisers are to be filed, they shall be filed within 45 dats after the notice of the report is sent to all parties and attorneys of record by United States certified mail. hid. Code § 32-24-1-11(a). 11. No exceptions to the Report of Appraisers have been filed in this case. 12. When,as here, no exceptions are filed within the prescribed statutory period, the Court apboisited appraisers' report is conclusive as a matter of law, arid there is no issue left for trial. Southern Indiana Gas Elec. Co. v. Decker, 307 N.E. 2d 51 (Ind. 1974). 13. On or about November 25, 2025, the State deposited the sum of$1,000.00 with the Clerk of Court, in satisfaction of the total just compensation award. Additionally, on or about November 25, 2025, the State deposited the sum of$3,000.00, which represents the appraisers' fees. 14.. The State is entitled to judgment for appropriation, with total just compensation set in the amount of$1,000.00. JIT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that Plaintiff State of .Indiana, now holds title to the real estate described in Exhibit A and depicted in Exhibit B. IT IS FURTHER ORDERED, ADJUDGED, AND DECREED that Defendants Gene A. Pflug and Gloria J. Pflug, husband and wife, as tenants by the entirety, shall recover$1,000.00 as total 1 . just compensation for the State's real estate condemnation.
